0414CITY OF SOUTHLAKE, TEXAS ORDINANCE NO. 414 AN ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS AMjENDING ORDINANCE NO. 334, THE CITY'S COMPREHENSIVE ZONING oRDINANCE, BY AMENDING SECTION 3.2 BY ADDING A DEFINITION OF HOTEL OR MOTEL, AND BY AMENDING SECTION 5 BY ADDING A NEW SUBSECTION 5-22 HOTEL DISTRICT; PROVIDING A PENALTY NOT TO EXCEED THE sUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED coMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council finds that all legal requirements relative to public notice and public hearings have been complied with and that the Planning and Zoning Commission has recommended the City Council consider and approve an amenclment to ordinance No. 334 as set forth herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY coUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Section 1. That ordinance No. 334, the City's basiC Comprehensive Zoning ordinance, is hereby amended by adding the following as definition number 42A to Section 3.2: "42A. HOTEL OR MOTEL A building or arrangement of buildings designed and occupied as a temporary abiding place of individuals who are lodged with or without meals, in which the rooms are usually occupied single for hire, and in which there are no provisions for cooking in individual rooms. No. 334, the City's basic is hereby amended by adding the Section 2. That Ordinance Comprehensive Zoning Ordinance, following subsection to Section 5 as follows: "Sec. 5-22 HC Hotel District. pURPOSE: The NC District is established to accommodate hotel-motel development. HC Districts to include extensive open space and landscaping provide areas to are intended and should be located in areas which can take advantage of the regional access provided by the freeway system and within reasonable proximity to the Dallas-Fort Worth International Airport. USES GENERALLY: In an HC Hotel District no land shall be used and no building shall be erected for or converted to any use other than as hereinafter provided. PERMITTED USES: No building or structure, or part thereof, shall be erected, altered or used, in whole or in part, for other than one or more of the following specified uses: Hotels and motels, except that hotels/motels shall be permitted only exception use; all suite as a special Parks and playgrounds which are publicly owned; and Golf courses which are publicly or privately owned. ACCESSORY USES: The following uses shall be permitted as accessory uses to a principal use provided that none shall be a source of income to the owner or user of the principal use: 1. Off-street parking in conjunction with a permitted use; Signs for advertising uses on the premises; Indoor and outdoor swimming pools; and Tennis courts, health clubs and related recreation facilities provided they are for the primary use of guests, customers or persons associated with the principal use. OTHER ANCILLARY USES: Generally and commonly accepted auxiliary uses reasonably related to the principal use of the hotel or motel and located within the interior of the hotel or motel shall be permitted. SPECIAL USES: The following uses may be permitted provided a Special Exception Use Permit is issued pursuant to Section 14.4 of the Comprehensive Zoning Ordinance; and the following minimum standards are met: Ail suite hotels and motels, including kitchen facilities, provided that such facilities shall not be utilized for permanent rentals; the maximum -2- length of a rental shall not exceed forty-five (45) days and conversion to permanent rentals units is expressly prohibited." HEIGHT AND AREA REGULATIONS: The maximum height of a hotel or motel shall be six (6) stories. The following minimum area depth standards shall be required: a. Depth of front yard ................ 30 feet; Depth of side yard .................. 15 feet, except where abutting a lot zoned or used for residential purposes, in which case the requirement shall be for a 25 foot side yard; and Depth of rear yard ................. 10 feet, except where abutting a lot zoned or used for residential purposes, in which case the requirement shall be for a 25 foot rear yard. SITE PLAN APPROVAL REQUIRED: A general site plan and landscape plan shall be required to be submitted as a prerequisite to the issuance of a building permit for a hotel or motel. The site plan shall contain the general information required for a site plan to be submitted for an S-P-2 Site Plan District as set forth in Section 5-19 of this Ordinance. The City Council and the Planning and Zoning Commission shall have the right and authority to require additional more-detailed information. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect.
