0404CITY OF SOUTHLAKE, TEXAS ORDINANCE NO. 404 AN ORDINANCE AMENDING ORDINANCE NO. 334, THE ZONING ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS, AS AMENDED, BY RECLASSIFYING CERTAIN ZONING DISTRICTS LOCATED WITHIN THE CITY OF SOUTHLAKE, TEXAS AND MORE FULLY SET FORTH ON A MAP OF THE CITY OF SOUTHLAKE, TEXAS, ATTACHED TO THIS ORDINANCE; REQUIRING DEVELOPMENT OF THE TRACT TO BE IN ACCORDANCE WITH ALL RELEVANT REGULATIONS; REVISING THE OFFICIAL ZONING MAP; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND THE ZONING CHANGE AND AMENDMENT HEREIN MADE; PROVIDING A PENALTY OF NOT MORE THAN TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE AND DECLARING THAT A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINI3ES; PROVIDING A SAVINGS CLAUSE; AND PROVIDING A SEVERABILITY CLAUSE. WHEREAS, the City Council of the City of Southlake, Texas (the "City"), has found and determined that certain zoning districts within the City, as shown on a map of the City attached as Exhibit "A" hereto, are presently classified as "LC," "HC," and "LI" districts; and WHEREAS, Ordinance No. 334 of the City, as amended (the "Zoning Ordinance") has no provisions for zoning districts with classifications of "LC," "HC," and "LI"; and WHEREAS, the City Council of the City hereby finds and determines that it is necesary to reclassify certain zoning districts within the City for the purpose of conformity with the classifications and regulations of zoning districts set forth in the Zoning Ordinance; and WHEREAS, the suggested to the Planning and Zoning recommendation and report; and reclassifications were submitted Commission of the City for its WHEREAS, the Planning and Zoning Commission of the City and the City Council, in compliance with the laws of the State of Texas and with the provisions of the Zoning Ordinance of the City, have given the requisite notices by publication and otherwise and have held due hearings and afforded a full and fair hearing to all property owners generally and to the persons interested and situated in the affected areas and in the vicinity thereof; and WHEREAS, the City Council does hereby find and determine that the reclassification of the zoning districts shown on Exhibit "A" is in the best interest of the public health, safety, morals and general welfare of the citizens of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Section 1~ That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. That Ordinance No. 334, the Zoning Ordinance of the City, passed and approved on August 19, 1986, as originally adopted and amended, be and the same is hereby amended and changed in the following particulars, and that all other existing sections, subsections, paragraphs, sentences, definitions, phrases and words of said Zoning Ordinance are not amended, but remain intact and are hereby ratified, verified, approved and affirmed: A. That the zoning classification of that tract of land, identified as Area No. 1 on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District, is hereby reclassified as "R-2 - Retail Two District"; and B. That the zoning classification of that tract of land, identified as Area No. 2 on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-2 - Retail Two District"; and C. That the zoning classification of that tract of land, identified as Area No. 3A on the map attached as Exhibit hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "O-1 - Office One District"; and D. That the zoning classification of that tract of land, identified as Area No. 3B on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-1 - Retail One District"; and -2- E. That the zoning classification of that tract of land, identified as Area No. 5 on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "I-2 - Industrial Two District"; and F. That the zoning classification of that tract of land, identified as Area No. 6 on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-1 - Retail One District"; and G. That the zoning classification of that tract of land, identified as Area No. 7 on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-2 - Retail Two District"; and H. That the zoning classification of that tract of land, identified as Area No. 8 on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "R-1 - Retail One District"; and I. That the zoning classification of that tract of land, identified as Area No. 10 on the map attached as Exhibit hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-1 - Retail One District"; and J. That the zoning classification of that tract of land, identified as Area No. 11 on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-1 - Retail One District"; and K. That the zoning classification of that tract of land, identified as Area No. 12 on the map attached as Exhibit hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-1 - Retail One District"; and L. That the zoning classification of that tract of land, identified as Area No. 13 on the map attached as Exhibit -3- hereto, presently zoned "LC - Light Commercial District, is hereby reclassified as "O-1 - Office One District"; and M. That the zoning classification of that tract of land, identified as Area No. 15 on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "O-1 - Office One District"; and N. That the zoning classification of that tract of land, identified as Area No. 16 on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-1 - Retail One District"; and O. That the zoning classification of that tract of land, identified as Area No. 19 on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-2 - Retail Two District"; and P. That the zoning classification of that tract of land, identified as Area No. 20A on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "0-1 - Office One District"; and Q. That the zoning classification of that tract of land, identified as Area No. 20B on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District, is hereby reclassified as "R-1 - Retail One District"; and R. That the zoning classificatIon of that tract of land, identified as Area No. 20C on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "R-1 - Retail One District"; and S. That the zoning classification of that tract of land, identified as Area No. 21 on the map attached as Exhibit "A" hereto, presently zoned "LI - Light Industrial District," is hereby reclassified as "1-2 - Industrial Two Planned Unit Development District"; and -4- T. That the zoning classification of that tract of land, identified as Area No. 25 on the map attached as Exhibit hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "O-1 - Office One District"; and U. That the zoning classificatIon of that tract of land, identified as Area No. 26 on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "R-1 - Retail One District"; and V. That the zoning classification of that tract of land, identified as Area No. 27 on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "O-1 - Office One District"; and W. That the zoning classification of that tract of land, identified as Area No. 33 on the map attached as Exhibit hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-1 - Retail One District"; and X. That the zoning classification of that tract of land, identified as Area No. 34A on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District, is hereby reclassified as "R-2 - Retail Two District"; and Y. That the zoning classification of that tract of land, identified as Area No. 34B on the map attached as Exhibit hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-2 - Retail Two District"; and Z. That the zoning classification of that tract of land, identified as Area No. 35 on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-2 - Retail Two District"; and AA. That the zoning classification of that tract of land, identified as Area No. 36 on the map attached as Exhibit -5- hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-2 - Retail Two District"; and BB. That the zoning classification of that tract of land, identified as Area No. 38A on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "R-2 - Retail Two District"; and CC. That the zoning classification of that tract of land, identified as Area No. 38B on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "I-2 - Industrial Two District"; and DD. That the zoning classification of that tract of land, identified as Area No. 39 on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "SF-1 - Single-Family District"; and EE. That the zoning classification of that tract of land, identified as Area No. 41 on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-2 PUD - Retail Two Planned Unit Development District"; and FF. That the zoning classification of that tract of land, identified as Area No. 42 on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "R-2 PUD - Retail Two Planned Unit Development District"; and GG. That the zoning classification of that tract of land, identified as Area No. 44 on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "0-2 - Office Two District"; and HH. That the zoning classification of that tract of land, identified as Area No. 45A on the map attached as Exhibit "A" -6- hereto, presently zoned "LI - Light Industrial District," is hereby reclassified as "I-2 - Industrial Two District"; and II. That the zoning classification of that tract of land, identified as Area No. 45B on the map attached as Exhibit "A" hereto, presently zoned "HC - Heavy Commercial District," is hereby reclassified as "I-2 - Industrial Two District"; and JJ. That the zoning classification of that tract of land, identified as Area No. 46 on the map attached as Exhibit "A" hereto, presently zoned "LC - Light Commercial District," is hereby reclassified as "R-1 - Retail One District." Section 3. The City Manager of the City is hereby directed to correct the official zoning map of the City to reflect the reclassifications in zoning described herein. Section 4. That the use of the certain tracts of land above described shall be subject to all applicable regulations contained in the Zoning Ordinance of the City and all other applicable ordinances of the City. Section 5. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and the general welfare of the community. They have been designed, with respect to both present conditions and the conditions reasonably anticipated to exist in the fore- seeable future, to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent over-crowding of land, to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, commercial needs and development of the community. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. Section 6. Any person violating any of the provisions of this ordinance shall be deemed guilt~ of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Thousand Dollars ($2,000.00). A separate offense shall be -7- deemed committed upon each day during or on which a violation occurs or continues. Section 7. This ordinance shall be cumulative of all other ordinances of the City affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this Ordinance. Section 8. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect.
