0401THE CITY OF SO HLARE, TEXAS AN ORDINANCE DECLARING UNCAPPED AND UNUSED OR ABANDONED WATER WELLS A NUISANCE; REQUIRING UNUSED OR ABAA!DONED WATER WELLS TO BE CAPPED; PROVIDING THAT, IN THE EVENT THE PROPERTY OWNER FAILS TO DO SO, THE CITY MAY CAP OR CAUSE TO CAPPED SUCH UNUSED OR ABANDONED WATER WELL AND CHARGE THE PROPERTY OWNER THEREFOR; PROVIDING FOR NOTICE TO PROPERTY OWNERS; PROVIDING A SEVERABILITY CLAUSE: PROVIDING FOR THE REPEAL OF INCONSISTENT ORDINANCES; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City hereby determines and declares that the existence of uncapped and unused or abandoned water wells constitutes a nuisance and a threat to the public health and safety of the inhabitants of the City; and WHEREAS, the City Council of the City hereby determines that all unused or abandoned water wells shall be capped; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. That all uncapped and unused or abandoned water wells located within the City shall be securely capped. Section 3. That it shall be the responsibility of the owner of the property on which such unused or abandoned water well is located to provide for the capping of such well. Section 4. That in the event that the owner of such property shall fail or refuse to comply with the requirements of this ordinance within ten (10) days after notice to do so, the City may cap such open unused or abandoned water well or cause the same to be done, and make payment therefor. The expenses incurred in so doing or having such work done shall be chargeable to the owner of such property and such charge shall be a personal liability of such owner and a lien upon the property, to the City. Section 5. Notice to the owner of property on which an unused or abandoned water well is located may be in writing, served upon such owner by an officer or employee of the City, or it may be by letter addressed to such owner, or if the r her's address is unknown, notice may be given by publishing a brief summary of such notice two (2) times within ten (10) days in some newspaper of general circulation in the City, addressed "Notice of Open Unused or Abandoned Water Well," and "To Whom It May Concern," and such publication shall be deemed sufficient notice. Section 6. That if any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto of any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 7. That all ordinances or parts of ordinances inconsistent or in conflict with the provisions of this ordinance are hereby expressly repealed to the extent of the inconsistency or conflict. Section 8. The fact that the present ordinances and regulations of the City of Southlake, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of Southlake, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare of the public which requires that this ordinance become ~ffective from and after the date of its passage and it is ~ccordingly so ordained.
