NO. 400 CITY OF SOUTHLAKE, TEXAS AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, PROVIDING FOR DEFINITIONS TO BE USED IN APPLYING CERTAIN PROVISIONS OF THE CITY CHARTER; PROVIDING A PROCEDURE FOR CALCULATING DEGREES OF AFFINITY AND CONSANGUINITY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING D~ EFFECTIVE DATE W~.'_,EREAS, Section 2.13 of the City Charter makes certain provisions and prohibitions regarding nepotism within City goverrm~ent; and WHEREAS, certain terms used within Section 2.13 of the Clty Charter have proved to be ambiguous or subject to various in%erpretations; and WHEREAS, proper enforcement of Section 2.13 of the City Charter is jeopardized by the ambiguity or inconsistent interpretation of certain terms contained in that Secnion; and WHEREAS, the City Council recognizes the importance of The fair and consistent enforcement and adherence to all provisions of the City Charter; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Section 1. As used in Section 2.13 of the City Charter, the following terms shall be defined as follows: (a) Office shall mean a right, authority, and duty created and conferred by law, by which, for a given contractual period, or at the pleasure of the City, an indivuduai is invested with some portion of the sovereign functions of the City, To be exercised by him for the benefit of the public and for pay. (b) Position shall mean a right, authority and duty not necessarily created by law, by which, for a given contractual period, or at the pleasure 0£ the City, an individual is invested with certain responslbll~le of the City, to be performed by him for the benefit of the public and for pay. (c) Clerk shall mean a person employed and paid by the City for a given contractual period or at the pleasure of the City to keep documents, records, accounts, minutes or other documents or data for the benefit of the public. (d) Service shall mean a person employed and paid by the City for a given contractual period or at the pleasure of the City to perform labor of any kind for the benfit of the public. Section 2. Charter, degree of calculated as follows: As used in Section 2.13 of the City affinity or consanguinity shall be (a) (J) Lineal affinity and consanguinity shall be determined by counting the generations between the parties whose kinship is being calculated. Example: Great-grandmother and great-granddaughter are related by lineal consanguinity of the third degree. Examp].e: Greas-grandmother and granddaughter's husband are related affinity of the third degree. great by lineal (ii) As used herein, lineal consanguinity and affinity shall mean That which exists between persons of whom one is descended (whether by blood or law) in a direct line from the other, as among great-grandmother, grandmother, mother and daughter. (b) (i) Collateral affinity and consanguinity shall be determined by counting the number of generations from the nearest common ancestor of the parties to either party, taking the longer of the two lines where they are unequal. Example: Brother and sister are related collateral consanguinity of the first degree. by Example: Brother and brother-in--law (sister's husband) are related by collateral affinity of the first degree. Example: related degree. Brother and niece (sister's daughter) are by collateral consanguinity of the second -2- (ii) As used herein, collateral consanguinity and affinity shall mean that which exists between persons who have the same ancestors (whether by blood or law), but who do not descend or ascend one from the other, as between brothers and sisters. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto, or any person or circumstance is held invalid on unconstitutior~al by a court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. effective after its PASSED 1987.
