0366CITY OF SOUT L .. TE=S AN ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS, ESTABLISHING A FEE NOT TO EXCEED THE SUM OF TWENTY-FIVE DOLLARS ($25.00) FOR THE ISSUANCE AND SERVICE OF A-WARRANT OF ARREST; REQUIRING THAT THE WARRANT FEE BE PAID INTO THE CITY TREASURY FOR THE USE AND BENEFIT OF THE CITY; PROVIDING A SEVERABILITY CLAUSE: DECLARING AN EF~ERGENCY AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake, Texas (the "City") is authorized and empowered by Tex. Code Crim. Proc. art. 45.06 (Vernon), as amended, to levy and collect a fee not to exceed the sum of twenty-five dollars ($25.00) for the issuance and service of a warrant of arrest according to the terms of that statute. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. Section 2. That a fee for the issuance and service of a warrant of arrest not to exceed the sum of Twenty-Five Dollars ($25.00) shall be imposed and collected by the City in the following instances: When a person fails to appear in accordance with article 38.11, Texas Penal Code (Vernon), as amended, and with article 6701d, 2149, Tex. Rev. Civ. Stat. Ann. (Vernon), as amended; and In all other instances where there has been a violation of a law or ordinance which imposes criminal penalties for violations thereof, pro- vided that written notice of the issuance of an arrest warrant and imposition of the warrant fee has first been. given to the offender. Section 3. That the City Manager, in conjunction and coordination with the Municipal Court Clerk, shall set and establish the amount of the warrant fee authorized herein, said amount not to exceed Twenty-Five Dollars ($25.00) for the issuance and service of a warrant of arrest. Section 4. That the funds collected pursuant to this ordinan.ce shall be paid into the City treasury for the use and benefit of the City. Section 5. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force ~nd effect. Section 6. The fact that the present ordinances and regulations of the City of Southlake, Texas are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of Southlake, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare of the public which requires that this ordinance become effective from and after the date of its passage and it is accordingly so ordained.
