0329ORDINANCE NO. ~? ANNEXING THE HEREINAFTER DESCRIBED TERRITORY INTO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN SAID CITY LIMITS; GRANTING TO ALL THE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID INHABITANTS BY ALL OF THE ACTS, ORDINANCES, RESOLUTIONS AND REGULATIONS OF SAID CITY; ESTABLISHING ZONING DISTRICTS FOR SUCH TERRITORY; CONTAINING A SEVERABILITY CLAUSE; AND SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS; an application and request for annexation has been made by the owner of the following described property, hich owner is a corporation duly operating within the State of Texas and is the owner of the following described property, to-wit: PROPERTY DESCRIPTION WHEREAS, DAN HOWELL, is the sole owner of a 10.329 acre tract of land situated in the John Wizwell Survey, A-1347 and in the R. D. WHEREAS; all of said territory is adjoining the City of Southlake, and, WHEREAS, the said request by the owner of the above described tract desiring and requesting the annexation of said territory to said City has been presented to the City Council; and WHEREAS; a plat of said tract being annexed showing the location of such land is attached hereto as Exhibit "A" and is for all purposes incorporated in and made a part of this tract. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION ONE: That the following described property, to-wit: PROPERTY DESCRIPTION BEING a tract or parcel of land situated in the John Wizwell Survey, A-1347 and in the R. SECTION TWO: The said tract, described in Section One above, is hereby annexed into the City of Southlake, Texas, as zoning district classified as "A-l", "Single Family". SECTION THREE: That, the official map and boundaries of the City of Southlake, Texas, as heretofore adopted and amended, be and the same is hereby amended so as to include the aforedescribed territory as a part of the City of Southlake, Texas. SECTION FOUR: This ordinance is being passed for the purpose of annexing into the City of Southlake, Texas the land or territory described in this ordinance. Should any section, article, provision or part of this ordinance be declared to the unconstitutional and/or void by a Court of competent jurisdiction, such decision shall in no way affect the validity of any of the remaining parts of this ordinance, or the annexation of the territory or land generally if effect can still be given to such annexation after such Court decision and unless the part held unconstitutional or void is found to be inseparable from and indispensable to the operation of the remaining parts. The City Council declares that it would have passed those parts of this ordinance which are valid and omitted any parts which may be unconstitutional if it had known that such parts were unconstitutional at the time of passage of this ordinance. -5- SECTION FIVE: That this ordinance shall become effective and be in full force and effect form and after its passage by the City Council, and approval by the Major and duly attested by the City Secretary of the City of Southlake, Texas, and publication in accordance with the laws of the State of Texas.
