ANNEXING THE HEREINAFTER DESCRIBED TERRITORY INTO THE CITY
OF SOUTHLAKE, TARRANT COUNTY, TEXAS, AND EXTENDING THE
BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID
HEREINAFTER DESCRIBED PROPERTY WITHIN THE SAID CITY LIMITS;
GRANTING TO ALL THE INHABITANTS OF SAID PROPERTY ALL OF THE
RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID
INHABITANTS BY ALL OF THE ACTS, ORDINANCES, RESOLUTIONS AND
REGULATIONS OF SAID CITY, ESTABLISHING A ZONING DISTRICT
FOR SUCH TERRITORY; CONTAINING A SEVERABILITY CLAUSE; AND
SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, an application and request for annexation has been made
by the owner of the following described property, which owner is a
corporation duly operating within the State of Texas and is the owner
of the following described property, to-wit:
PROPERTY DESCRIPTION
WHEREAS, DONALD F. FINN, is the sole OWNER of a 17.779 acre
tract of land situated in the THOMAS EASTER SURVEY, ABSTRACT NO.
474,and the P.R. Splane Survey, Abstract No. 1453, Tarrant County,
Texas, as recorded in Volume 2668, Page 486, of the Deed Records,
Tarrant County, Texas, and being more particularly described as
follows:
BEGINNING at a point in the northerly right-of-way line of the
S.W. and S.L. Railroad, said point also being the southeast corner of
that certain tract of land as described in deed to W. R. Wallace as
recorded in Volume 5487, Page 293, DRTCT;
THENCE N 00 degrees 22' 00" E. along the east line of said
Wallace tract, 991.75 feet to a point for corner;
THENCE 89 degrees 23' 00" E 1528.13 feet to a point for corner;
THENCE south 30.00 feet to a point for corner in an existing
fence linesaid iron pipe also being in the north right-of-way line of
said S.W. & S.L. Railroad.
THENCE S 58 degrees 38' 00" W along the said existing fence line
in the north right-of-way line of said S.W. & S.L. Railroad, 1500.12
feet to a point for corner;
THENCE S 57 degrees 02' 00" W. along the said existing fence line
in the north right-of-way line of the S.W. & S.L. Railroad, 302.18
feet to the POINT OF BEGINNING and containing 774,453 square feet or
17.779 acres of land.
WHEREAS, all of said territory is adjoining the City of
Southlake; and,
WHEREAS, the said request by the owner of the above-described
tracts desiring and requesting annexation of said territory to said
City has been presented to the City Council; and
WHEREAS, a plat of the said tract being annexed showing the
location of such land is attached hereto as Exhibit "A" and is for all
purposes incorporated in and made a part of this tract.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION ONE: That the following described property, to-wit:
PROPERTY DESCRIPTION
BEGINNING at a point in the northerly right-of-way
line of the S.W. & S.L. Railroad, said apoint also being the
southeast corner of that certain tract of land as described
in deed to W. R. Wallace as recorded in Volume 5487, Page
293 DRTCT;
THENCE N 00 degrees 22' 00: E. along the east line of
said Wallace tract, 991.75 feet to a point for corner;
THENCE 89 degrees 23' 00" E. 1528.13 feet to a point
for corner;
THENCE South 30.00 feet to a point for corner in an
existing fence line, said iron pipe also being in the said
north right-of-way of said S.W. & S.L. Railroad;
THENCE S 58 degrees 38' 00" W along the said existing
fence line in the north right-of-way line of said S.W. & S.
L. Railroad, 1500.12 feet to a point for corner;
THENCE S. 57 degrees 02' 00" W. along the said existing
fence line in the north right-ofway line of the S.W. & S.L.
Railroad, 302.18 feet to the POINT OF BEGINNING and
containing 774.453 square feet or 17.779 acres of land.
be and the same is hereby annexed to the City of Southlake, Tarrant
County, Texas, and the boundary limits of the City of Southlake,
Tarrant County, Texas, be and the same are hereby extended to include
the above-described territory within the city limits of the City of
Southlake, and the same shall hereafter be included within the
territorial limits of said City, and the inhabitants thereof shall
hereafter be entitled to all rights and privileges of other citizens
of the City of Southlake, and they shall be bound by the acts,
ordinances, resolutions and regulations of said city.
SECTION TWO: The said tract, described in Section One above, is
hereby annexed into the City of Southlake, Texas, as zoning district
classification as "LI", "Light Industrial".
SECTION THREE: That, the official map and boundaries of the City
of Southlake, Texas, as heretofore adopted and amended, be and the
same is hereby amended so as to include the aforedescribed territory
as a part of the City of Southlake, Texas.
SECTION FOUR: This ordinance is being passed for the purpose of
annexing into the City of Southlake, Texas the land or territory
described in this ordinance. Should any section, article, provision
or part of this ordinance be declared to be unconstitutional and/or
void by a Court of competent jurisdiction, such decision shall in no
way affect the validity of any of the remaining parts of this
ordinance, or the annexation of the territory or land generally if
effect can still be given to such annexation after such Court decision
and unless the part held unconstitutional or void is found to be
inseparable from and indispensable to the operation of the remaining
parts. The City Council declares that it would have passed those
parts of this ordinance which are valid or omitted any parts which may
be unconstitutional if it had known that such parts were
unconstitutional at the time of passage of this ordinance.
SECTION FIVE: That this ordinance shall become effective and be
in full force and effect from and after its passage by the City
Council, and approval by the Mayor and duly attested by the City
Secretary of the City of Southlake, Texas, and publication in
accordance with the laws of the State of Texas.
PRESENTED AND PASSED on the 18th day of March, 1986, at a regular
meet' of the City Council of the City o -,Southlake, Texas, by a vote
