0255 Ordinance No. 255 ANNEXING THE HEREINAFTER DESCRIBED TERRITORY INTO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, AND EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID HEREINAFTER DESCRIBED PROPERTY WITHIN THE SAID CITY LIMITS; GRANTING TO ALL THE INHABITANTS OF SAID PROPERTY ALL OF THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BINDING SAID INHABITANTS BY ALL OF THE ACTS, ORDINANCES, RESOLUTIONS AND REGULATIONS OF SAID CITY, ESTABLISHING A ZONING DISTRICT FOR SUCH TERRITORY; CONTAINING A SEVERABILITY CLAUSE; AND SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, an application and request for annexation has been made by the owner of the following described property, which owner is a corporation duly operating within the State of Texas and is the owner of the following described property, to-wit: PROPERTY DESCRIPTION WHEREAS, RICHARD OGLE, is the sole OWNER of a 5.0 acre tract of land situated in the R.D. PRICE SURVEY, ABSTRACT NO. 1207, Tarrant County, Texas, as recorded in the Deed Records, Tarrant County, Texas and being near Grapevine, Texas and being the same tract as conveyed to Richard M. Ogle and wife, Virginia, by deed recorded in Volume 6636, Page 223, of the Deed Records, Tarrant County, Texas and being more particularly described as follows: BEGINNING at an iron pin, said point being, by deed call, 250.0 varas South, and S. 00 degrees-13' E. 760.7 feet from the Southwest corner of the David Douthitt Survey, Abstract No. 448; THENCE N. 87 degrees-45' E. 1266.1.feet to an iron pin in the Southwesterly line of County Road No. 3016; THENCE S. 35 degrees-00' E. along said Southwesterly line 222.3 feet to an iron pin for corner; THENCE S. 89 degrees-34' W. 1392.1 feet to an iron pin for corner; THENCE N. 00 degrees-13' W. 143.0 feet to the POINT OF BEGINNING and containing 5.0 acres of land more or less, and being the same tract of land conveyed to Richard M. Ogle and wife Virginia, by deed of record in Volume 6636, Page 223, Deed Records, Tarrant County, Texas. WHEREAS, all of said territory is adjoining the City of Southlake; and, WHEREAS, the said request by the owner of the above- described tracts desiring and requesting annexation of said territory to said City has been presented to the City Council; and WHEREAS, a plat of the said tract being annexed showing the location of such land is attached hereto as Exhibit "A" and is for all purposes incorporated in and made a part of this tract. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION ONE: That the following described property, to-wit: BEGINNING at an iron pin, said point being, by deed call, 250.0 varas South, and S. 00 degrees-13' E. 760.7 feet from the Southwest corner of the David Douthitt Survey, Abstract No. 448; THENCE N. 87 degrees-45' E. 1266.1 feet to an iron pin in the Southwesterly line of County Road No. 3016; THENCE S. 35 degrees-00' E. along said Southwesterly line 223.3 feet to an iron pin for corner; THENCE S. 89 degrees-34' W. 1392.1 feet to an iron pin for corner; THENCE N. 00 degrees-13' W. 143.0 feet to the POINT OF BEGINNING and containing 5.0 acres of land more or less, and being the same tract of land conveyed to Richard M. Ogle and wife Virginia, by deed of record in Volume 6636, Page 223, Deed Records, Tarrant County, Texas. be and the same is hereby annexed to the City of Southlake, Tarrant County, Texas, and the boundary limits of the City of Southlake, Tarrant County, Texas, be and the same are hereby extended to include the above-described territory within the city limits of the City of Southlake, and the same shall hereafter be included within the territorial limits of said City, and the inhabitants thereof shall hereafter be entitled to all rights and privileges of other citizens of the City of Southlake, and they shall be bound by the acts, ordinances, resolutions and regulations of said city. SECTION TWO: The said tract, described in Section One above, is hereby annesed into the City of Southlake, Texas, with a zoning district classification of "Ag.", "Agricultural". SECTION THREE: That, the official map and boundaries of the City of Southlake, Texas, as heretofore adopted and amended, be and the same is hereby amended so as to include the aforedescribed territory as a part of the City of Southlake, Texas. SECTION FOUR: This ordinance is being passed for the purpose of annexing into the City of Southlake, Texas the land or territory described in this ordinance. Should any section, article, provision or part of this ordinance be declared to be unconstitutional and/or void by a Court of competent jurisdiction, such decision shall in no way affect the validity of any of the remaining parts of this ordinance, or the annexation of the territory or land generally if effect can still be given to such annexation after such Court decision and unless the part held unconstitutional or void is found to be inseparable from and indispensable to the operation of the remaining parts. The City Council declares that it would have passed those parts of this ordinance which are valid or omitted any parts were unconstitutional at the time of passage of this ordinance. SECTION FIVE: That this ordinance shall become effective and be in full force and effect from and after its passage by the City Council, and approval by the Mayor and duly attested by the City Secretary of the City of Southlake, Texas, and publication in accordance with the laws of the State of Texas.
