ORDINANCE NO. 252
AN ORDINANCE CREATING A POLICE RESERVE
FORCE AND PROVIDING FOR ARREST AND CITATION:
WHEREAS, A necessity exists for trained personnal to be available
in case of a National Emergency; And,
WHEREAS, A possibility exists that there could be a local
emergency wherein there will be a need for additional officers
other than the regular police officers; Now,
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TARRANT COUNTY, TEXAS:
Sec. 1 A Reserve Police force is hereby established. The Reserve
police force shall be under the supervision of the Chief
of Police, subject to the Ordinances of the City of Southlake,
Texas, laws of the State of Texas and the Laws of the State
of Texas and the laws of the United States.
Sec. 2 There shall be appointed by the Mayor, subject to the approval
of the City Council, such number of reserve policemen as
the City Council may direct.
Sec. 3 All reserve policemen shall be of good moral character
and shall hold office subject to the will of the City Council.
Sec. 4 All reserve policemen shall take the oath as prescribed
by law and after such oath, the Mayor shall issue a
commission.
Sec. 5 All reserve policemen shall wear uniforms prescribed by
the police chief and shall wear a badge as prescribed
by the Chief of Police, however, such badge shall have the
words "Reserve Policemen" on it.
Sec. 6 The Chief of Police shall set up a training program in order
that the reserve policemen shall become proficient in police
work and especially in the evacuation procedures and
catastrophies.
Sec. 7 While said policemen are on duty and under the supervision
of a regular policemen of the town, they shall have the
right to carry and use firearms to the same extent as a
regular policemen but no authority is given under this ordinance
to permit any reserve policemen to carry firearms when he is
off duty.
Sec. 8 The reserve policemen shall not receive a salary from the city
however, the city may, at the discretion of the City Council
purchase equipment for the reserve policemen.
Sec. 9 Oath required of applicants:
Every person whose name appears on the list of eligibles
referrej to in section 10 shall subscribe to an oath that
he will observe and obey the Constitution of this State,
and the laws of this nation, this state and this city and
that he will carry out the duties of a member of the police
reserve force to the best of his ability.
Sec. 10 A list of eligibles complied by the Chief of Police and
accompanied by a complete set of fingerprints or supple-
mented immediately by fingerprinting by the police department,
which fingerprints shall be checked by the identification
bureau to ascertain any criminal record of such person,
shall be maintained by the police department. Members
of the police reserve shall be appointed by the City Council
from such list of eligibles.
Sec. 11 Power of arrest/citation:
A member of the police reserve force shall have the following
powers of arrest and none other:
(1) He may arrest or write citations for offences only while
he is on active duty.
(2) He may arrest or write a citation for a public offense
committed in his presence.
(3) He may arrest when a felony has in fact been commited,
when he has reasonable cause for believing the person
arrested has committed it.
(4) He may lend physical aid to any regular member of the police
department.
Sec. 12 No member of the police reserve force shall break into or other-
wise forcefully enter upon private property or enter upon
private property or enter the dwelling or habitation of
another person without the consent of a member of the police
department who then and there requests has aid in the
enforcement of the law.
Sec. 13 Termination of membership generally:
Membership of any person in the police reserve may be ter-
minated by the Chief of Police, at any time for any cause
deemed sufficient by the Chief of Police, and any member
may resign from the police reserve at any time, but it shall
be his duty to notify the chief of his resignation.
