AN ORDINANCE CREATING THE SOUTHLAKE CI1Y PLANNING AND
ZONING COMMISSION, PRESCRIBING THE DUTILS AND QUALIFi-
CATIONS OF IlS MEMBERS AND THEIR TE~q OF OFFICE, PRO-
VIDING FOR THE APPOINTMENT OF ITS MEMBERS, THE M£1HO[~
OF FILLING VACANCIES, MAKING STAFF SERVICES AVAILABLE
TO THE CiTY PLANNING AND ZONING COMMISSION, PRESCRIB-
ING POWERS AND DUTIES OF THE CITY PLANNING AND ZONING
COMMISSION, PROVIDING FOR ADOPTION OF RULES AND REGU-
LATIONS , REPEALING ORDINANCE NO. 64, CREATING A
SOUTHLAKE CITY PLANNING AND ZONING COMMISSION, AND
PROVIDING A SAVINGS CLAUSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS.
SECTION 1
There is hereby created and established within the City of South]aRe,
Texas, a City Planning and Zoning Commission which shall be subject to the jur~s-
d]~.tion of the Sou%h'iaKe C~t¥ Council. Such City Planning and Zon~n9 Comm]ss~,3n
sha;] be composed of seven (7) members, whose off~ces are hereby createO an~
establisne~. The members of the City Planning an~ Zoning Commission shall De
resident citizens of the corporate limits of the City of Southlake, Texas, an~
qualifieo voters of the City of Southlake, Texas. The members of the City
Planning and Zoning Commission shall be appointed by the City Council The
term of office of said members shall be three (3) years; provided, however, at

mne which members shall serve one (1), two (2), or three (3J year terms,
%hereafter, as the members' term expire, the new term shall be for three ~.
years, w~tn .the initial terms from the adoption of this ordinance until May
ist, 1974, and from May 1st of each year thereafter; but a member may be re-
quested %o serve until a replacement is'appointed. After the appointment of
the original members thereof, all vacancies occurring on the City Planning
and Zoning Commission shall be filled by appointment of the City Council.
Following the drawing of lots, the membership will determine hy simple
majority vote a Chairman and a Secretary, said Secretary to serve as Chair-
man in his absence. The offices of Chairman and Secretary will be for the
periOd of one (1) year, with the initial terms from the adoption of this
ordinance until May 1st, 1974, and from May 1st of each year thereafter.
SECTION 2
The Planning and Zoning Commission shall receive reports, advice and
available services from the various City Departments as required eno as
directeo by the Mayor, or his designated representative~ When directeo by
the Mayor, any Department Head or official of the City of Southlake shall
be available to the Planning and Zoning Commission for advice and consulta-
tion, and they shall cooperate with and render such services for the
Planning and Zoning Commission as shall come within the scope of the duties
of the Mayor.
SECTION 3
The City Planning and Zoning Commission shall have the power and
authority and it shall be its duties'
ia} To make studies and project plans for the improvement of the City
of SoutnlaKe, with a view of its development and extension, and to recommend
all matters for the development and advancement of the City facilities, lay-
outs and appearance and to perform the Uuties imposed upon the City Planning
and Zoning Commission by the Statutes of the State of lexas.
(D) To study and recommeno plans of the wholu or any portion of the
City of Southlake and of land outside the Ctt~ limits located within one-
half (~) mile of such City limits, and any other land outside the City of
Southlake which in the opinion of the City Planning and Zoning Commission
bears a relation to the planning of the City of Southlake and to recommend
such changes in additions and extensions of plans or maps within the City
as it deems same advisable.
(c) To aid and assist the Mayor in the procuring of financial and
other aids and assistance for the City from the State and Federal Govern-
ments and their agencies for each and all of the purposes herein enumerated.
(d} To act with and assist all other municipal boards,governmental
agencies, regional associations and especially the City Council in formulat-
ing proper plans for municipal development.
{e) To plan and Fecommend the location, plan and extent of city alley-
ways, parks, playgrounds, airports, automobile parking places and other
public grounds, and public improvements, for the location and planning of
public buildings, schools and other properties and of public utilities includ~
trig bus terminals, railroad depots and terminals, whether public or privately
owned, for water, lights, sanitation, sewer disposal~ drainage, flood control,
transportation, communication and shipping facilities, and for the removal,
relocation, widening, extension, narrowing, vacating, abandonment or change
of use of any of the foregoing public places, works~ buildings, facilities
or utilities.
(f) To select and recommend routes of streets, avenues and boulevards
and particularly to investigate and recommend the opening, widening or aban-
donment of streets, avenues, boulevards and alleyways, and drainage ways or
the changing thereof to conform to the City's systemj, present and future, all
streets, avenues, boulevards, alleyways, drainage ways and parks.
(g) To investigate, consider and make recommendations about the lay-
out and plan of any new subdivision to the City of Southlake on property
located within one-half (~} mile of the City limits and to act upon plans,
plats or replats of additions, within the City limits or within o~e-half (½)
mile of the City limits in a manner described from time to time by the City
Council.
{h) To recommend general rules and regulatio~)s governing plats and
subdivisions of land within the corporate limits of the City of Southlake
or within one-half (~) mile of the corporate limits of the City, to promote
health, safety, moral and general welfare of the community, and the safe
and orderly and healthful development of the community.
(i) To recommend plans for improving, developing, expanding and
beautifying the parks, lakes and public build~ngs i~ o~' adjacent to the City
and to cooperate with the City Council and other agencies of the City in
advising, establishing, locating, improving, selecting, expanding and main-
taining the public parks, playgrounds and lakes for public recreation.
(j} To aid and assist the City Council by recommending plans for the
development of civic centers and to make investigations, consider and make
recommendations concerning traffic regulations.
(k) To revie~ all zoning regulations and make rece~mendations on
amendments thereto and to review and make recommendations on exceptions
permitted under Ordinance No. 161. This duty shall not be construed as
the power to grant variances as stated in Article 1011a-1011j, CivilStatuteso
(1) To serve as the Zoning Co~mission in order that the City may avail
itself of the powers confer)'ed by Articles 1011a-101~j, and specifically
for the City Planning Commission to serve as a Zoning Commission as stated
in Article 1011-f.
(m) To recommend the boundaries of the various districts into which
the City should be zoned and to recommend appropriate regulations to be
enforced therein. The Planning and Zoning Commission shall hold public
hearings thereon following which it will submit a report for City Council
consideration.
SECTION 4
Said City Planning and Zoning Commission shall make such rules and
regulations !or its own government and designate such time and place for
holding regular meetings as it deems proper. Four (4) members of the City
Planning and Zoning Com~ission shall constitute a quorum for the trans-
action of business.
SECTION 5
Should any member of the City Planning and Zoning Commission be
absent for three (3) consecutive regular meetings, or fail to attend a
total of four (4) regular or special meetings of the City Planning and
Zoning Commission during any three (3) month period, provided that the
City Planning and Zoning Commission had scheduled four (4) or more meetings
during such a three (3) month period, it shall be the responsibility of
the Chairman, or in his absence the Secretary, of the City Planning and
Zoning Commission to notify the City Council, through the City Secretary,
with a record of said absences and of any and all circumstances related
to the absences. The City Council shall have sole authority to replace
such memberF'if in their opinion such action is justified.
SECTION 6
All tha~ certain Ordinance No, 64, entitled "An Ord;nance Creatin~ a
Planning and Zoning Commission for the Town of Southlake" is hereby repealed.
In the event of conflict between any provision of this ordinance and Ordi-
nance No. 160 and/or Ordinance No. 161 of the City of Southlake, then, the
provisions of Ordinance No. 160 and/or Ordinance No. 161 shall prevail.
SECTION 7
If any section, subsection, sentence, clause, phrase or portion of
this ordinance is for any reason held invalid or constitutional by an court
of competent jurisdiction, such section, subsection, sentence, clause,
phrase or portion shall be deemed separate, distinct and an independent pro-
vision and such holding shall not affect the validity of the remaining
portion hereof.
SECTION 8
This ordinance shall be in full force and effec~ from and after the
date of its passage and adoption by the City Council.
