0161-CORDI 'IANCE NO. '6-' AN ORDINANCE AMENDING ORDINANCE NO. 161 OF THE CITY OF SOUTHLAKE, TEXAS, BY ADDING A NEW PARAGRAPH 1. "ALTERNATE MEMBERS" TO SECTION XVII OF ORDINANCE 161 PROVIDING FOR THE APPOINTMENT OF TWO ALTERNATE MEMBERS TO THE ZONING BOARD OF ADJUSTMENT, THE TERMS OF OFFICE OF THE ALTERNATE MEMBERS, AND THE DUTIES OF SAID ALTERNATE MEMBERS; BY CHANGING DESIGNATION OF EXISTING PARAGRAPHS 1, 2 AND 3 OF SECTION XVII OF ORDINANCE 161 TO PARAGRAPHS 2, 3 AND ~; BY PROVIDING A SEVERABILITY CLAUSE; BY PROVIDING FOR CUMULATIVE AFFECT~ AND BY PROVIDING FOR EFFECTIVE DATE AND PUB- LICATION. WHEREAS, the City Council of the City of Southlake, mexas, deems it necessary, for the purpose of promoting the health, safety, morals and/or general welfare of the City to enact amendr ments to Ordinance 161 of the City of Southlake, Texas; and WHEREAS, the City Council held public hearings and found amended; of the City of Southlake, Texas, that such Ordinance should be BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT SECTION XVII OF ORDINANCE 161 BE, AND THE SAME IS HEREBY~ AMENDED AS FOLLOWS: SECTION 1. Ordinance bio. 161 of the City of Southlake, Texas is hereby amended by including and/or changing the following designated portions thereof: Adding a new paragraph 1 to Section XVII immediately following the introductory paragraph thereof: "1. Alternate Members the City Council shall appoint two alternate members of the Board, who shall serve in the absence of one or more of the regular memgers of the Board when requested to do so by the Mayor, so that all cases to be heard by the Board will always be heard by four members. These alternate members, when appointed, shall serve for three (3) year terms, and any vacancy among alternate members shall be filled in the same manner as a vacancy among regular members of the Board. The alternate members shall also be removable for cause in the same manner as the regular members of the Board." I,lumbering the existing paragraphs 1, 2 and 3 of Sec- tion XVII. as "2" "3" and "k". SECTIO~I 2. SEVERABILITY CLAUSE. Should any section or paragraph or part of this amending Ordinance be declared by the Courts to be unconstitutional or invalid, such decision shall not affect the validity of the amending ordinance as a whole, any part thereof, other than the parts so declared to be uncon- stitutional or invalid. SECTION 3. REPEAL OF CONFLICTING ORDINANCES. All ordi- nances or parts of ordinances in direct conflict with any other provisions of this amending ordinance are hereby repealed in- sofar as the same are in direct conflict with the provisions hereof; however, any ordinance requiring a more stringent or detailed provision shall remain in force to such extent. SECTIO~I B. EFFECTIVE DATE. This ordinance shall become effective and be in full force and effect as an amendment to Ordinance 161 of the City of Southlake, Texas, from and after its passage and publication as required by law, and publication of the caption hereof as a summary of said ordinance is hereby ordered and authorized.
