0107 ORDINANCE NO. 107 AN ORDINANCE CREATING AND ESTABLISHING A CORPORATION COURT IN THE TOWN OF SOUTHLAKE, TEXAS; PROVIDING FOR JURISDICTION THEREOF AND FOR A JUDGE OF SAID COURT, TO BE KNOWN AS RECORDER; FURTHER PROVIDING FOR THE ELECTION ~t OF SAID RECORDER AND FOR THE APPOINTMENT OF A RECORDER; PROVIDING THAT THE TOWN SECRETARY SHALL BE EX-OFFICIO CLERK OF SAID COURT AND DUTIES OF SAID CLERK; FURTHER PROVIDING FOR REGULAR AND SPECIAL SESSIONS THEREOF AND FOR AN EFFECTIVE DATE. WHEREAS„ pursuant to Title 28, Chapter 16, Articles 1194 to 1200 inclusive, 1925 Revised Civil Statutes of Texas, as amended provides for the creation of corporation courts, for cities, towns and villages incorporated pursuant to provisions of Title 28 Revised Civil Statutes of Texas; and, WHEREAS,, Article 1197 as amended by the Acts 1953, 53rd Legislature.,, Page 39, Chapter 31, Section 1, of said Title provides the procedure for the selection of a. Recorder of said Court in all cities, towns and villages not incorporated under special charter; and WHEREAS, the Town of Southlake, Texas, is duly incorporated and is now functioning pursuant to the provisions of Article 961, Title 28 VATS; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF SOUTHLAKE, TEXAS: 1. THAT, there is hereby created and established in the Town of Southlake, Texas, a court, to be known as the "CORPORATION COURT OF THE TOWN OF SOUTHLAKE, TEXAS." 2. THAT such court shall have jurisdiction within the territorial limits of the Town of Southlake, Texas, in all criminal cases arising under the ordinances of said Town, and shall also have concurrent jurisdiction with any justice of the peace in any precinct in which said Town is situated in all criminal cases arising under the criminal laws of this State, and arising within its territorial limits, in which punishment is by fine only, and where the maximum of such fine may not exceed Two Hundred Dollars ($200.00). 3. THAT such court shall be presided over by a judge, to be a r known as the "Recorder" who shall be appo;_nted by the Mayor with the advice and consent of the Town Council. 4. THE Town Secretary shall be ex-officio Clerk of the Court herein created, and the Town Council may in its discretion, appoint a deputy to said Town Secretary with the same power and duties as_Brein conferred upon said Secretary. -5. THE Clerk of the Court shall keep minutes of the proceedings of the said Court, issue all process, and generally perform all the duties of the Clerk of a Court as prescribed by law for a County Clerk insofar as the same may be applicable. 6. THE Corporation Court shall hold one regular session weekly at such time and place as the Town Council may designate, and such special sessions as the Recorder may deem necessary to care for the business before said Court. 7. THIS ordinance shall become effective and be in full force and effect immediately upon its adoption. ADOPTED this 14th day of September A. D. 1957. APPROVED: ATTEST:- MAYOR TOWN SECRETARY
