A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TEXAS, CANCELLING THE MAY 4, 2024, GENERAL AND SPECIAL
ELECTIONS AND DECLARING EACH UNOPPOSED CANDIDATE ELECTED
TO OFFICE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas ("City") is a home rule city acting under
its Charter adopted by the electorate pursuant to Article XI, Section
5 of the Texas Constitution and Chapter 9 of the Local Government
Code; and,
WHEREAS, the City of Southlake Charter provides that City Elections shall be
held in accordance with the laws of the State of Texas; and,
WHEREAS, Section 41.001(a) of the Texas Election code, as amended by the
84th Texas Legislature, establishes the first Saturday in May as a
Uniform Election date for the purposes of conducting a General
Election; and,
WHEREAS, Section 3.004(b) of the Texas Election Code provides that the
governing body of a municipality shall be the authority to order a
General Election for the purposes of electing members to the
governing body; and,
WHEREAS, the Council approved Resolution No. 24-001, calling the General
and Special Elections of May 4, 2024, for the purpose of electing
Mayor and City Council Place 2 and Place 3; and,
WHEREAS, the filing deadlines for placement on the ballot and declaration of
write-in candidacy have passed; and,
WHEREAS, the City Secretary has certified in writing to the Governing Body
that each candidate on the ballot is unopposed for election to office;
and,
WHEREAS, in these circumstances Subchapter C of Chapter 2 of the Election
Code authorizes a governing body to declare each unopposed
candidate elected to office and to cancel the election.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS, THAT:
Section 1. The following candidates, who are unopposed in the May 4, 2024
General and Special Elections, are hereby elected to office, and
shall be issued Certificates of Election following the time the
election would have been canvassed:
Office Candidate Term
Mayor Shawn McCaskill 2027
City Council, Place 2 Randy Robbins 2027
City Council, Place 3 Frances Scharli Fill vacancy: 2025
Section 2. The May 4, 2024, General and Special Elections are cancelled, and
the City Secretary is directed to post a copy of this order on May 4,
2024, at each polling place that would have been used in the
election.
Section 3. This resolution shall be effective upon its adoption.

RESOLUCION DEL CONCEJO MUNICIPAL DE LA CIUDAD DE SOUTHLAKE,
TEXAS, POR LA QUE SE CANCELAN LAS ELECCIONES GENERALES Y
ESPECIALES DEL 4 DE MAYO DE 2024 Y SE DECLARA ELECTO A CADA
CANDIDATO SIN OPOSICION; Y SE DISPONE UNA FECHA DE ENTRADA
EN VIGENCIA.
CONSIDERANDO QUE, la Ciudad de Southlake, Texas (denominada de ahora en
adelante la "Ciudad") es una ciudad autonoma actuando en virtud del
Estatuto adoptado por el electorado de conformidad con el Articulo XI,
Seccion 5 de la Constitucion de Texas y el Capitulo 9 del Codigo de
Gobierno Local; y
CONSIDERANDO QUE, el Estatuto de Ia Ciudad de Southlake establece que
las Elecciones de la Ciudad se realicen de conformidad con las
leyes del Estado de Texas; y
CONSIDERANDO QUE, Ia Seccion 41.001(a) del Codigo Electoral de Texas,
modificado por Ia 84a Legislatura de Texas, establece que el primer
sabado de mayo sea Ia fecha de la Eleccion Uniforme para realizar
la Eleccion General; y
CONSIDERANDO QUE, la Seccion 3.004(b) del Codigo Electoral de Texas
establece que el organismo gubernamental de una municipalidad
sea la autoridad encargada de ordenar una Eleccion General para
elegir a los miembros del organismo gubernamental; y
CONSIDERANDO QUE, el Ayuntamiento aprobo Ia Resolucion N.° 24-001 que
convoca la Eleccion General y Especial del sabado 4 mayo 2024
con la finalidad de elegir al Alcalde y a los miembros del
Ayuntamiento que ocuparan los puestos 2 y 3; y
CONSIDERANDO QUE, han transcurrido los plazos de presentacion para ser
incluido en la papeleta de votacion y para la declaracion de
candidatura por nominacion directa; y
CONSIDERANDO QUE, el secretario municipal ha certificado por escrito ante el
organismo gubernamental que todos los candidatos en la papeleta
carecian de oposicion para ser electos al cargo; y
CONSIDERANDO QUE, en esas circunstancias, el Subcapitulo C del Capitulo 2
del Codigo Electoral autoriza el cuerpo gubernamental a declarar
que los candidatos sin oposicion se consideren elegidos para el
cargo y a cancelar la eleccion.
POR TANTO, EL AYUNTAMIENTO DE LA CIUDAD DE SOUTHLAKE, TEXAS,
RESUELVE QUE:
Seccion 1. Los siguientes candidatos no tuvieron oposicion en Ia Eleccion
General del sabado 4 mayo 2024 y por to tanto, se considera que
fueron elegidos para el cargo y deberan emitirse certificados de
eleccion luego de Ia fecha en que debieran haberse solicitado los
votos para Ia eleccion:

Puesto 2 del Ayuntamiento Randy Robbins 2027
Puesto 3 del Ayuntamiento, Frances Scharli Ocupa puesto
vacante: 2025.
Seccion 2. Se cancelan la Eleccion General y Especial del 4 de mayo y se
solicita al Secretario Municipal que publique una copia de esta
orden el 4 mayo de 2024, en cada lugar de votacion programado
para usarse en la eleccion.
Seccion 3. Esta resolucion entrara en vigencia una vez adoptada.
