A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE,
TARRANT AND DENTON COUNTIES, TEXAS, ORDERING A GENERAL
ELECTION TO BE HELD ON MAY 4, 2024, FOR THE PURPOSE OF ELECTING
THE MAYOR AND CITY COUNCIL PLACE 2; AND ORDERING A SPECIAL
ELECTION TO BE HELD ON MAY 4, 2024, FOR THE PURPOSE OF ELECTING
CITY COUNCIL PLACE 3, TO FILL A VACANCY; DESIGNATING LOCATION OF
POLLING PLACE; ORDERING NOTICE OF ELECTION TO BE GIVEN AS
PRESCRIBED BY LAW IN CONNECTION WITH SUCH ELECTIONS;
AUTHORIZING EXECUTION OF JOINT ELECTION AGREEMENTS AND
CONTRACTS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas ("City") is a home rule city acting under its charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution
and Chapter 9 of the Local Government Code; and,
WHEREAS, the City of Southlake Charter provides that City Elections shall be held in accordance
with the laws of the State of Texas; and,
WHEREAS, Section 41.001(a) of the Texas Election Code establishes the first Saturday in May
as a Uniform Election date for the purposes of conducting an election; and,
WHEREAS, Section 3.004 of the Texas Election Code provides that the governing body of a
municipality shall be the authority to order an election for the purposes of electing
members to the governing body; and,
WHEREAS, the City will enter into Joint Election Agreements and Contracts for election services
with Tarrant and Denton Counties pursuant to Texas Election Code Sections 31.092
and 271.002.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TARRANT AND DENTON COUNTIES, TEXAS, THAT:
SECTION 1. A General Election is hereby ordered for May 4, 2024, to be held jointly with the
Carroll Independent School District for the purpose of electing the Southlake City
Council Mayor and Place 2, each such term being for a period of three (3) years. The
filing period for the General Election will begin on January 17, 2024, and will end on
February 16, 2024, at 5:00 p.m., in accordance with State Law.
SECTION 2. A Special Election is hereby ordered for May 4, 2024, to be held jointly with the
Carroll Independent School District for the purpose of electing the Southlake City
Council Place 3, to fill a vacancy, for the unexpired term ending in May 2025. The
filing period for the Special Election will begin on January 17, 2024, and will end on
February 16, 2024 at 5:00 p.m., in accordance with State Law.
SECTION 3. Pursuant to the Joint Election Agreement and Contract (the "Contracts"), the
Elections Administrator of Tarrant and Denton Counties shall serve as Elections
Administrator for the elections. Presiding Election Judges and Alternate Presiding
Election Judges appointed to serve the authorized polling places and the early voting
clerk and deputy early voting clerks shall be those election officials furnished by the
Elections Administrator from the list of proposed election judges as required in the
Contracts. The Mayor is hereby authorized to execute Contracts with the Tarrant
and Denton Counties Elections Administrators for the General and Special Election
on May 4, 2024. The Mayor shall have further authority to approve any minor
modifications as may be necessary in the best interest of the City. In the event of a
conflict between this resolution and the Contracts, the Contracts shall control. A
voting system or systems meeting the standards and requirements of the Texas
Election Code, as amended, is hereby adopted, and approved for early voting by
personal appearance and by mail and for election day voting.
SECTION 4. Notice of the General and Special Election shall be posted on the bulletin board used
to post notice of the City Council meetings, the City's website and be published in a
newspaper of general circulation in the City. That said notice must be published at
least once, not earlier than the 30th day nor later than the 10th day, before Election
Day as provided in Section 4.003(a)(1) of the Texas Election Code. A copy of the
published notice that contains the name of the newspaper and the date of publication
shall be retained as a record of such notice, and the person posting the notice shall
make a record of the time of posting, starting date, and the place of posting.
SECTION 5. On Election Day, May 4, 2024, the polls shall be open between the hours of 7:00
a.m. and 7:00 p.m.

SECTION 6. Early voting by personal appearance shall commence on April 22, 2024 and continue
through April 30, 2024, at the locations established by Tarrant and Denton Counties
on the dates and times as follows, or as may be amended by either County, per the
Contract.

executed with the Tarrant and Denton Counties Elections Administrators.
SECTION 7. Applications for ballot by mail shall be received and processed by the Tarrant and
Denton County Elections Administrators, as follows:

It is required for an applicant submitting an application for ballot by mail via fax or
email to also submit an application for ballot by mail via mail. In order for a faxed or
email application for ballot by mail to be effective, the accompanying mailed
application for ballot by mail must be received within 4 days of the submission of the
application by fax or email.
Applications for ballots by mail must be received no later than the close of business
on April 19, 2024.
SECTION 8. For purposes of processing ballots cast in early voting, the election officers for the
early voting ballot board for this election shall be appointed and designated in
accordance with the provisions of the Contracts.
SECTION 9. The City Secretary shall present the General and Special Election returns to the City
Council at a Council meeting for the canvassing of said elections in accordance with
the Texas Election Code. The candidate for Mayor and City Council Place 2 and
Place 3 that receives a majority of valid votes by qualified voters at the elections
shall be declared elected. In the event no candidate receives a majority of all the
votes cast for all the candidates for an office, a runoff election shall be conducted on
the date set forth in the Contracts or other date ordered by the City Council in
accordance with the Southlake City Charter and State law.
SECTION 10. The elections shall be held in accordance with the Constitution of the State of Texas
and the Election Code, and all resident qualified voters of the City shall be eligible to
vote in the elections. The Mayor and the City Secretary, in consultation with the City
Attorney, are hereby authorized and directed to take any and all actions necessary to
comply with the provisions of the Code in carrying out and conducting the elections,
whether or not expressly authorized herein.
SECTION 11. This Resolution shall take effect immediately upon its passage.

TARRANT Y DENTON, EN TEXAS, POR LA QUE SE ORDENA QUE SE REALICE UNA ELECCION
GENERAL EL 4 DE MAYO DE 2024 PARA ELEGIR AL ALCALDE Y AL PUESTO 2 DEL CONCEJO
MUNICIPAL; Y POR LA QUE SE ORDENA QUE SE HAGA UNA ELECCION ESPECIAL EL 4 DE MAYO DE
2024, PARA ELEGIR AL PUESTO 3 DEL CONCEJO MUNICIPAL, PARA CUBRIR UNA VACANTE;
TAMBIEN SE DESIGNA EL LUGAR DE VOTACION Y SE ORDENA QUE SE NOTIFIQUE LA ELECCION
SEGIJN LO PRESCRIBE LA LEY EN RELACION CON DICHAS ELECCIONES; SE AUTORIZA LA
CELEBRACION DE ACUERDOS Y CONTRATOS ELECTORALES CONJUNTOS; Y SE DISPONE UNA
FECHA DE ENTRADA EN VIGOR.
CONSIDERANDO QUE la Ciudad de Southlake, Texas ("Ciudad") es una ciudad autonoma que actUa en
virtud de sus estatutos adoptados por el electorado de conformidad con el Articulo XI, Seccion
5 de la Constitucion de Texas y el Capitulo 9 del Codigo de Gobierno Local; y,
CONSIDERANDO QUE la Carta de la Ciudad de Southlake establece que las Elecciones de la Ciudad se
Ilevaran a cabo de acuerdo con las leyes del Estado de Texas; y,
CONSIDERANDO QUE la SecciOn 41.001(a) del Codigo Electoral de Texas establece el primer sabado
de mayo como fecha electoral uniforme a efectos de la celebracion de elecciones; y,
CONSIDERANDO QUE la Seccion 3.004 del Codigo Electoral de Texas establece que el organo de
gobierno de un municipio sera la autoridad para ordenar una elecciOn con el fin de elegir a los
miembros del organo de gobierno; y,
CONSIDERANDO QUE la Ciudad celebrara Acuerdos y Contratos Electorales Conjuntos para servicios
electorales con los Condados de Tarrant y Denton de conformidad con las Secciones 31.092
y 271.002 del Codigo Electoral de Texas.
POR LO TANTO, EL CONSEJO DE LA CIUDAD DE SOUTHLAKE DE LOS CONDADOS DE TARRANT Y
DENTON, EN TEXAS, RESUELVE LO SIGUIENTE:
SECCION 1. Por medio del presente documento se ordena que se realice una Eleccion General el 4 de
mayo de 2024, a celebrarse juntamente con el Distrito Escolar Independiente de Carroll con el
proposito de elegir al Alcalde y al Puesto 2 del Concejo Municipal de Southlake, siendo cada
uno de dichos terminos por un periodo de tres (3) anos. El periodo de presentacion de
candidaturas para la Eleccion General comenzara el 17 de enero de 2024 y finalizara el 16 de
febrero de 2024 a las 5:00 p.m., de conformidad con la Ley Estatal.
SECCION 2. Por medio del presente documento se ordena que se realice una Eleccion Especial el 4 de
mayo de 2024, a celebrarse juntamente con el Distrito Escolar Independiente de Carroll con el
con el fin de elegir el Lugar 3 del Concejo Municipal de Southlake, para cubrir una vacante,
por el termino no vencido que terming en mayo de 2025. El periodo de presentacion de
candidaturas para la Eleccion Especial comenzara el 17 de enero de 2024 y terminara el 16
de febrero de 2024 a las 5:00 p.m., de conformidad con la Ley Estatal.
SECCION 3. De conformidad con el Acuerdo y Contrato Electoral Conjuntos (denominados de ahora en
adelante los "Contratos"), el Administrador Electoral de los Condados de Tarrant y Denton
actuara como Administrador Electoral para las elecciones. Los Jueces Electorales
Presidentes y los Jueces Electorales Presidentes Suplentes designados para prestar servicio
en los colegios electorales autorizados y el secretario de votacion anticipada y los secretarios
adjuntos de votacion anticipada seran los funcionarios electorales designados por el
Administrador de Elecciones a partir de la lista de jueces electorales propuestos segUn to
requerido en los Contratos. Por medio del presente documento se autoriza al Alcalde a
celebrar los Contratos con los Administradores de Elecciones de los Condados de Tarrant y
Denton para las Elecciones Generales y Especiales del 4 de mayo de 2024. El Alcalde tendra
ademas la autoridad necesaria para aprobar toda modificacion menor que pueda ser necesaria
y beneficiosa para la Ciudad. En caso de conflicto entre esta resolucion y los Contratos,
prevaleceran los Contratos. Por la presente se adopta y aprueba un sistema o sistemas de
votacion que cumplan las normas y requisitos del Codigo Electoral de Texas, en su version
modificada, para la votacion anticipada por comparecencia personal y por correo y para la
votacion el dia de las elecciones.
SECCION 4. El aviso de las Elecciones Generales y Extraordinarias se colocara en el tablero de anuncios
utilizado para publicar el aviso de las reuniones del Ayuntamiento, en la pagina web de la
Ciudad y se publicara en un periodico de circulacion general en la Ciudad. Dicho aviso debera
publicarse al menos una vez, no antes del dia 30 ni despues del dia 10, antes del dia de las
elecciones, tal y como establece la Seccion 4.003(a)(1) del Codigo Electoral de Texas. Se
conservara una copia del aviso publicado que contenga el nombre del periodico y la fecha de
publicaciOn como constancia de dicho aviso, y la persona que publique el aviso hard constar
la hora de publicacion, la fecha de inicio y el lugar de publicaciOn.
SECCION 5. El dia de las elecciones, el 4 de mayo de 2024, las urnas estaran abiertas entre las 7:00 a.m.

Es obligatorio que el solicitante que presente una solicitud de voto por correo por fax o correo
electronico presente tambien una solicitud de voto por correo postal. Para que una solicitud de
voto por correo enviada por fax o correo electronico sea efectiva, la solicitud de voto por correo
que la acompana debe recibirse en un plazo de 4 dias a partir de la presentacion de la solicitud
por fax o correo electronico.
Las solicitudes de voto por correo deberan recibirse a mas tardar al cierre de operaciones del
19 de abril de 2024.
SECCION 8. A los efectos del procesamiento de los votos emitidos en la votacion anticipada, los
funcionarios electorales de la junta electoral de votacion anticipada para esta eleccion seran
nombrados y designados de conformidad con las disposiciones de los Contratos.
SECCION 9. El Secretario de la Ciudad presentara los resultados de las Elecciones Generales y Especiales
al Concejo Municipal en una reunion del Concejo para el escrutinio de dichas elecciones de
acuerdo con el Codigo Electoral de Texas. El candidato a Alcalde y al Puesto 2 y al Puesto 3
del Concejo Municipal que reciba la mayoria de los votos validos de los votantes calificados
en las elecciones sera declarado electo. En caso de que ningun candidato reciba la mayoria
de todos los votos emitidos para todos los candidatos a un cargo, se Ilevara a cabo una
segunda vuelta electoral en la fecha establecida en los Contratos u otra fecha ordenada por el
Concejo Municipal de conformidad con el Estatuto de la Ciudad de Southlake y la ley estatal.
SECCION 10. Las elecciones se celebraran de acuerdo con la Constitucion del Estado de Texas y el Codigo
Electoral, y todos los votantes residentes cualificados de la Ciudad tendran derecho a votar en
las elecciones. Por medio del presente documento, se solicita y autoriza al Alcalde y al
Secretario de la Ciudad, en consulta con el Abogado de la Ciudad a tomar todas y cada una
de las medidas necesarias para cumplir con las disposiciones del Codigo al Ilevar a cabo y
realizar las elecciones, esten o no expresamente autorizados para hacerlo en el presente
documento.
SECCION 11. La presente Resolucion entrara en vigor inmediatamente despues de su aprobacion.
