Childress No. 253 Addition EXECUTIVE SUMMARY: On behalf of MG Luxury Homes, Barton Chapa Surveying is requesting approval of a Plat Showing for Lots 8 and 9, J. Childress No. 253 Addtion on property described as Tract 1E02, John Childress Heirs Survey, Abstract No. 253, City of Southlake, Tarrant County, Texas and located at 1425 Randol Mill Ave., Southlake, Texas. Current Zoning: "SF-1A" Single Family Residential District. SPIN Neighborhood #5. DETAILS: The project is generally located on the east side of Randol Mill Ave. approximately 400’ south of the intersection of Davis Blvd. and Randol Mill Ave. The purpose of this request is to seek approval of a two lot Plat Showing in conformance with the Zoning Change and Concept Plan (ZA21-0037) that was approved by City Council on August 3, 2021. The Zoning Change and Concept Plan from “AG” Agricultural District to “SF-1A” Single Family Residential District was approved to divide an existing approximately 2.887 acre tract of land into two single family residential lots that conform to the “SF-1A” Single Family Residential zoning district, which requires a minimum lot area of 43,560 square feet (one acre). The plat conforms to the previously approved Zoning Change and Concept Plan. Two driveways that were constructed with the improvements to Randol Mill Ave. provide access to the proposed lots. No changes to the existing driveways are proposed. HISTORY: - The property was annexed into the City in 1987 and given the “AG” Agricultural District zoning designation. - A single family home that was constructed in 1975 prior to annexation was demolished in 2019. - A Zoning Change and Concept Plan (ZA21-0037) from “AG” Agricultural District to “SF-1A” Single Family Residential District to divide an existing approximately 2.887 acre tract of land into two single family residential lots that conform to the “SF-1A” Single Family Residential zoning district, which requires a minimum lot area of 43,560 square feet (one acre) was approved by City Council on August 3, 2021. SOUTHLAKE 2035 PLAN: Consolidated Future Land Use Plan The 2035 future land use designation for the site is Low Density Residential. Purpose: The purpose of the Low Density Residential land use category is to provide for and to protect low intensity detached single-family residential development that promotes the openness and rural character of Southlake. Definition (this definition was updated by passage of Ordinance No. 1186 on February 20, 2018): The Low Density Residential category is for detached single-family residential development at a net density of one or fewer dwelling units per acre. Net density is the number of dwelling units per net acre, which excludes acreage in all rights-of-way, easement, and lots designated for public or private streets. Other suitable activities are those permitted in the Public Parks / Open Space and Public / Semi- Public categories. The Low Density Residential category encourages the openness and rural character of the City of Southlake. Pathways Master Plan & Sidewalk Plan The Master Pathways Plan shows a future ≥8’ multi-trail on the east side of Randol Mill Ave. An 8’ multi-use trail was constructed with the improvements to Randol Mill Ave. TRANSPORTATION Case No. Attachment A ZA21-0083 Page 2 ASSESSMENT: Area Road Network and Conditions The Master Thoroughfare Plan shows Randol Mill Ave. to be a six-lane divided arterial with 130’ to 140’ of right of way. Adequate right of way exists for Randol Mill Ave. Traffic Impact Two driveways that were constructed with the improvements to Randol Mill Ave. provide access to the proposed lots. No changes to the existing driveways are proposed. TREE PRESERVATION: Both lots comply with the Existing Tree Cover Preservation Requirements of the Tree Preservation Ordinance 585-E. Lot 1 has 34% of existing tree cover and a minimum of 60% is required to be preserved. A total of 60% of the existing tree cover is proposed to be preserved. Lot 2 has 46% of existing tree cover and a minimum of 50% the existing tree cover is required to be preserved. A total of 75% of the existing tree cover is proposed to be preserved. UTILITIES: The property is served by an existing 12” water line in Randol Mill Ave. City sewer is not available to the property, so the lots will be served by on-site sewage facilities (OSSF). The applicant has provided site suitability analyses for both lots that were prepared by a geotechnical engineer stating that the lots are suitable for surface discharge (aerobic) systems. DRAINAGE: Existing drainage is generally west to east across the property. CITIZEN INPUT: A SPIN meeting for this project was held on May 25, 2021. Please make the following changes to the plat in accordance with Subdivision Ordinance No. 483, as amended, Section 3.04, which requires that all requirements of Sections 3.01 and 3.03 be satisfied for submittal: 3. Provide the standard approval block for a plat showing with two or more lots on the plat per appendix 9: 4. Label all monuments as to size and type and state whether they are found or set. The legend of abbreviations includes “CRS” for Capped Rebar Set, but the set monuments are not labeled on the plat. Label the bearings and distances from all set monuments to the existing monuments in the vicinity on the face of the plat. 5. The following changes are needed with regard to the legal description: a. The POB must be tied to a survey corner, previously filed subdivision corner, or USGS monument. b. In the beginning call, a reference is made to “…said Northcutt tract and said Blackburn tract…”, but these tracts are not previously described. Please provide the deed Case No. Attachment C ZA21-0083 Page 2 document numbers for these tracts as you did with the Chen tract in the first call after the beginning call. After that you can refer to them as said Northcutt tract and said Blackburn tract. c. In the first call after the beginning call, provide a monument for the southeast corner of the lot and label type and size of monument and that it was set. Provide bearings and distances from the set monument to the existing monuments in the vicinity that match bearings and distances shown and labeled on the plat. The bearing and distance to the ½ inch rebar with cap stamped “LBS” in the metes and bounds does not match bearing and distance labeled on the face of the plat and the bearing and distance to the 1/2 inch rebar stamped “MILLER” is not shown and labeled on the face of the plat. d. In the second call after the beginning call, a ½ in rebar with pink cap stamped “BARTON CHAPA” set is referenced, but the monument is not labeled on the face of the plat. e. In the third and fourth calls after the beginning call, describe the monument set in the metes and bounds, label it on the plat and include the bearing and distance to the ½ inch rebar stamped “LBS” that is labeled on the face of the plat in the metes and bounds. Label the correct chord length and arc length on the face of the plat and revise the metes and bounds to match. 6. Add a lienholder statement and signature block with notary to the plat (see attached). If there is/are no lienholder(s) then add the statement “There are no liens against this property” at the end of the owner’s dedication right before the signature block. The standard language for these statements is attached. 7. Show and dimension the full extent of the right of way for Randol Mill Ave. (F.M. 1938) in accordance with the current Master Thoroughfare Plan. Dimension full width from across R.O.W. if opposite side has dedicated their half. Provide dimensions from both property corners. See the plat for Lots 5&3, J. Childress No. 253 Addition as an example. 1. Add the following notes to the face of the plat: a. The City of Southlake reserves the right to require minimum finish floor elevations on any lot contained within this addition. The minimum elevations shown are based on the most current information available at the time the plat is filed and may be subject to change. Additional lots, other than those shown, may also be subject to minimum finish floor criteria. b. Compliance with the provisions of the City’s Storm Drainage Policy does not relieve a person of the responsibility of complying with all other applicable laws, including, but not limited to, Section 11.086, Texas Water Code. * The Master Pathways Plan shows a future greater than or equal to 8’ multi-use trail along the east side of F.M. 1938. An existing 8’ multi-use trail is shown on the Concept Plan. * TxDOT approval is required for any changes to the curb cut locations for driveways. * Any fencing erected along or parallel to F.M. 1938 shall comply with the Architectural Fencing requirements of the Corridor Overlay District in Zoning Ordinance No. 480, as amended, Section 43.9(c)1(f): Case No. Attachment C ZA21-0083 Page 3 Architectural Fencing: All architectural fencing which runs roughly parallel to the SH 114, Carroll Avenue, FM 1709, FM 1938 rights-of-way, shall be constructed of the primary masonry materials of the building, wrought iron or living plant material. General Informational Comments * A SPIN meeting was held on May 25, 2021. * All plats filed must have an original signed and stamped Tax Certificate submitted with it from each taxing unit with jurisdiction of the real property, indicating that no delinquent taxes are owed and that taxes for the current year have been paid. After September 1st, a certificate showing that the taxes for that year are paid, but that the taxes for the upcoming year have yet to be calculated is required. (House Bills 1563 & 3101). A copy of this information may be obtained from the Tarrant County Tax Assessor/Collector’s Office located at 100 E. Weatherford St. in Ft. Worth (across from the old red courthouse). There is a service charge of $10 per account for this certificate.
