21-017 RESOLUTION NO. 21-017 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR OUTDOOR SALES AND SERVICES ON PROPERTY DESCRIBED AS LOT 2R, KIMBALL PARK, AN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS LOCATED AT 2101 E. STATE HWY. 114, SOUTHLAKE TEXAS. MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for outdoor sales and services has been requested by a person or corporation having a proprietary interest in the property zoned as "S-P-2" Generalized Site Plan District; and, WHEREAS, in accordance with the requirements of Sections 45.1(39) and 45.11 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted to allow outdoor sales and services on property within the City of Southlake, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall Resolution No. 21-017 be applicable to the granting of this Specific Use Permit: June 1, 2021; Approved (7-0) subject to the Staff Report dated May 25, 2021 and the Specific Use Permit Review Summary No.2 dated May 14, 2021; noting we are approving the Specific Use Permit to allow the outdoor sales and services to be in a 28-foot Airstream "shop" within the State of Texas Park at District 114 at the Kimball Park square. Also, approving the signage associated with the Airstream shop as presented this evening and noted in the staff report. Sales will be limited to products associated with Fury Athletix LLC, such as athletic apparel, headwear, and associated accessories. The Airstream shop will be in operation at the Texas Park Plaza during the year but will be permitted to travel offsite to special events approximately 10-15 days a year; noting that should the Airstream be removed more than 60 consecutive days; it will be replaced with potted landscape material approved by staff. The Specific Use Permit is approved for a 5-year term and tied to the Fury Athletix LLC's office space lease on the 4th floor of the District 114 office building and limiting the Airstream to this location only. The Airstream will be located at District 114 almost every day of the year. However,we anticipate taking the Airstream offsite for special events. We do not believe this will be more than 10-15 days a year. Provide the term of the specific use permit. Is it tied to the lease space in the building and/or extensions of the lease? We are requesting the 10-year term of the Special Use Permit and,yes,it is tied to the Fury Athletix LLC"s lease of office space for their corporate headquarters on the 4th floor of District 114 which is for 5 years and one 5-year extension. If the trailer moves to different locations, provide information on how it is moved in and out of the proposed site. The Airstream is moved in and out of the site using a remote-controlled dolly that moves the Airstream very slowly until it is positioned in the service drive on the north side of District 114.At that point it is attached to Ram 1500 TRX which will transport it to an offsite location. Will the trailer have access to restrooms in the office building for the sales staff and visitors? Electric is provided from a 60 AMP pedestal located directly behind the Airstream.
