Item 4DCASE NO: SV21-0009 SOUTHLAKE PLANNING & DEVELOPMENT SERVICES STAFF REPORT May 25, 2021 PROJECT: Sign Variance for Metairie at Southlake EXECUTIVE SUMMARY: Hawkins Wellwood Homes is requesting approval of a variance to Sign Ordinance No. 704, as amended, to allow a series of 13 pieces of metal artwork signs currently installed in two open space landscape medians (Lots 3X and 4X, Block 5 Metairie at Southlake). The existing artwork signs are located at 110 Metairie Lane, Southlake, Texas. REQUEST DETAILS: Case No. SV21-0009 The Metairie at Southlake subdivision is located approximately 950 -feet south of the southwest corner of N. White Chapel Blvd. and W. Dove Road, and approximately 130 -feet west of N. White Chapel Blvd. on two Metairie Lane open space medians. The applicant is requesting a variance to Sign Ordinance No. 704, as amended, is to seek approval to allow a series of 13 pieces of metal artwork signs currently installed in the open space landscaped medians (1 in the east median and 12 in the west median) on Metairie Lane to remain in the subdivision medians. The signs are not a permitted sign type within the Sign Ordinance No. 704, as amended, in Section 5.2.30 - Any sign not specifically permitted in the Sign Ordinance. HISTORY: -A Zoning Change was approved by City Council May 6, 1997, changing the zoning on the property from "AG" Agricultural District to "S -P-2" Generalized Site Plan District to include "CS" Community Service, "0-1" Office District, "C-1" Neighborhood Commercial District, "C-2" Local Retail Commercial District, "C-3" General Commercial District, "B-1" Business Service Park District and "HC" Hotel District uses (Case No. ZA96-130 and Ord. No. 480-220). - A Zoning Change and Site Plan for Southlake Center (ZA13-096) from "SP -2" Generalized Site Plan District to "S -P-2" Generalized Site Plan District with "C-3" General Commercial District uses to also allow a fuel station and outdoor sales areas as shown on the site plan was tabled at the November 21, 2013 Planning and Zoning Commission meeting to the January 9, 2014 meeting. The requested site plan proposed approximately 443,000 square feet of development with an approximately 113,531 square foot grocery store with a drive-through pharmacy and an approximately 96,000 square foot department store as the main anchor stores in the development. This case and the associated Preliminary Plat for Southlake Center (ZA13-097) were withdrawn January 9, 2014. - A Site Plan for Town and Country (ZA14-099) for the development of six retail and restaurant buildings totaling approximately 165,320 square feet and the associated Preliminary Plat (ZA14-100) were withdrawn on April 13, 2015. May 1, 2018; City Council approve a zoning change and development plan for Metarie of Southlake subject to the Staff Report dated April 24, 2018 and the Development Review Summary No. 7, dated April 23, 2018 (see below), and granting the following variances: Subdivision Ordinance No. 483, Section 5.03.F, which includes minimum centerline radii for curvilinear streets and separation requirements for reverse circular curves. The alignment shown for Kirkwood Blvd does not meet the requirements in the table. The applicant is requesting to allow the alignment shown, which is approved; Noting, this is not a gated community; Noting, the area defined in the zoning exhibit as Tract A, Case No. Attachment A SV21-0009 Page 1 Kirkwood Grove West, Ordinance No. 480-220a, the SP -2 Zoning District boundaries established in Ordinance No. 480-220 will be revised to reflect the exhibits presented and provided in the staff report; There will be no additional changes to existing zoning SP -2 Zoning District for Tract A and all zoning requirements, conditions, uses and vested rights from Ordinance No. 480-220 previously approved for this property will remain; and noting, [approval of] the area defined in the zoning exhibits as Metairie, Ordinance No. 480-729 (ZA17-060) SIGN BOARD: May 20, 2021; Approved (5-0) the sign variance request. Variance Criteria: 9.6.2 VARIANCES a. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Case No. Attachment A SV21-0009 Page 2 Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign Board's recommendation will be forwarded to the City Council for their consideration.
