2006-064RESOLUTION NO.06-064 OFFICIAL RECORD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR TELECOMMUNICATIONS TOWERS, ANTENNAS, AND ANCILLARY BUILDINGS ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, BEING LEGALLY DESCRIBED AS TRACT 1J, SITUATED IN THE REES D PRICE, SURVEY, ABSTRACT NO. 1207, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED CONCEPT PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for telecommunications towers, antennas, and ancillary buildings has been requested by a person or corporation having a proprietary interest in the property zoned as "CS" Community Service District; and, WHEREAS, in accordance with the requirements of Section 45.1 (31) and Section 45.8 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof, and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for the telecommunications towers, antennas, and ancillary buildings on the property being legally described as Tract 1J, situated in the Rees D. Price Survey, Abstract No. 1207, more fully and completely described in Exhibit "A", and as depicted on the approved Concept Plan attached hereto and incorporated herein as Exhibit `B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. To this end, the Public. Works department has schcduled the rc-painting of the water tower located at 600 W, Dove Rd. With Elie interior and exterior of the tank require routine painting to prevent chipping and rusting as well as to keep the water tower attractive, The elevated storage tanks are inspected annually and generally rizquire painting approximately every 15 years. The Dove water tank will be covered for approximately 3-4 months in the near ft]tUM This is necessary w prevent paint ovcrspray froin leaving the site. As I am sure you have notictxL located on the Dove Tank are several telecommunications antennas. This project will require the removal and temporary relocation of the two (2) cellular pro-6&r5 f-orn the tank's pedestal to temporary poles on the property, Piease note that this is only a temnnrary measure and all antennas will be relocated to the water tank as soon as the Painting is completed.
