2004-010RESOLUTION NO. 04-010 OFFICIAL RECORD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, ADOPTING REVISIONS TO THE SOUTHLAKE PUBLIC LIBRARY'S COMPUTER USE POLICY ACCOUNTING FOR TECHNOLOGY CHANGES AND UPGRADES; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake (the "City") strives to achieve the maximum efficiency and effectiveness in the delivery of services to its residents; and WHEREAS, the City Council established policies for the Southlake Public Library (the Library") prior to the opening of the facility in order to provide systematic and consistent guidance in the administration of providing library services; and WHEREAS, the City recognizes that the Library has a responsibility to control access as necessary to electronic (computer) resources to allow fair access to those resources, and change the current policy to reflect the utilization of the new automated computer reservation and print management software Pharos); and WHEREAS, the City recognizes that the Library realizes that adult supervision is required and that a parent or guardian make every reasonable effort to supervise use of the electronic (computer) resources by children under the age of 12; and WHEREAS, the City recognizes that the Library requires the acceptance of the Computer Use Policy by all users to make available access to electronic (computer) resources. The new reservation automation system requires acceptance of the Computer Use Policy before allowing access to a work station, thus no longer requiring a paper "use of computer lab agreement"; and WHEREAS, the City recognizes that the Library will allow access to electronic resources for non -cardholders, or people who have misplaced or forgotten their Library card, only after presenting a valid drivers license or other picture identification. Access will be made available after sign in at reference desk by Library staff entering a temporary card number, and acceptance by customer of the Computer Use Policy at the workstation; and WHEREAS, The City recognizes that the Library will allow customers to utilize electronic resources for one hour, at the conclusion of which usage will be subject to demand. Customers, who have exceeded one h our, if there is unsatisfied demand, can be removed from w orkstations t o allow fair and equitable access. Computers may also be reserved 24 hours in advance of needed use; and WHEREAS, the City recognizes that the Library is responsible for Computer Use within the Library and that customers may not use the available computers for any illegal purpose, including viewing materials deemed inappropriate to Children per Texas Penal Code 43:24 regarding the Sale, Distribution or Display of Harmful Materials to a Minor; and WHEREAS, The City desires to establish these revisions in the current Computer Use Policy to provide systematic and consistent guidance in the administration of these desired policy goals; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, THAT: Section 1: The City of S outhlake h ereby adopts the proposed revisions to the Library's C omputer Use Policy accounting for technology changes and upgrades, a copy of which is attached hereto as Exhibit "A" and which is incorporated by reference herein. Farwell, City Secretary =_ H ; I CO V Southlake Public Library Board Policies and Procedures Manual Policy: Computer Use Policy Source: City Council Category: Administration Effective Date: July 17, 2001, Revised February 3, 2004 Statement of Purpose The purpose of this policy is to provide consistent guidance for the Southlake Public Library staff in regards to public use of computers. Policy Statement Public use computers are available to all who meet the following criteria: To use the computer, the customer must have their Southlake Library card, and/or a valid driver's license or picture identification. 2. The Computer Lab agreement must be agreed by all users. 3. For children under the age of twelve (12), the parent or legal guardian must reserve the computer and remain with the child (ren) while the equipment is in use. The parent or legal guardian must be present and make every reasonable effort to supervise use by child (ren). Computer use guidelines: SPL cardholders may utilize any available cornputers,, or reserve a computer for future use up to 24 hours in advance, except for designated youth computers. Non cardholders must sign in at Reference Desk. Youth cardholders under the age of 12 may utilize available designated youth computers. Youth non cardholders need to check in at youth desk. 2. Customers will be able to utilize computers for one hour, after the conclusion of one hour use will be subject to demand (including reservations for computers). Customers who have exceeded one hour can be removed from computers in order to allow fair access. 3. The computers will be available until (5) minutes before closing. 4. Printing will be available according to the Fee Schedule. 5. Only one customer at a time unless permitted by staff. 6. Computers may be reserved up to 24 hours in advance; otherwise computers will be assigned on a first come first serve basis. 7. Library staff is available to assist customers but cannot provide in-depth consulting or training. Customers may download information to a disk only on computers designated with that capability. 9. Customers may not load personal software. 10. No peripheral equipment may be used on the Library computers with the exception of accommodations per the Americans with Disabilities Act. 11. Customers may not attempt to modify, add to, or remove any system element. 12. Customers may not attempt or assist unauthorized access to privileged or confidential computer system elements. 13. System maintenance must be performed by authorized persons only. 14. Customers must not use the Library's computers for any illegal purpose, including viewing materials deemed inappropriate to children per Texas Penal Code 43:24 regarding the Sale, Distribution or Display of Harmful Material to a Minor. 15 Virus checking software is available on Southlake Public Library computers, but cannot rotect users from all viruses. The Southlake Public Library is not responsible for damage to a customer's disc or computer; nor is it responsible for lost, missing, or incorrectly saved data. 15. Customers may not save information or data on the computer's hard drive. If any abuse of privilege or violation of these rules is observed, or otherwise indicated, the customer will be instructed to cease and desist, or the session may be terminated by library staff, and the individual (s) will be asked to vacate the premises for a period of time to be determined by library staff CHILD USE OF COMPUTER LAB AGREEMENT I have read the Internet Use Policy and the Computer Lab Use Policy and agree to abide by these policies and procedures. I understand that failure to abide by the Southlake Public Library policies and procedures for Internet use and Computer Lab use may result in a one-week suspension of computer privileges. Subsequent violations may result in the loss of any and all library privileges for twelve months. As parent, guardian or other responsible care giver of I give permission for my child to use the Computer Lab and to access the Internet at the Southlake Public Library. I understand that I must accompany my child if under the age of 12. 1 understand that 1, not the Library staff, am responsible for monitoring my child's appropriate use of the Internet and that I am responsible for any damage that may occur through my child's use of the Computer Lab and /or the Internet.
