2002-072RESOLUTION NO. 02-072 O"M RECORD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, APPOINTING AN ACTING CITY SECRETARY, AND PROVIDING FOR AN EFFECTIVE DATE UPON PASSAGE AND APPROVAL. Whereas, a Home Rule Charter of the City of Southlake, Texas, was approved by the voters in a duly called Charter election on April 4, 1987; and, Whereas, in the Home Rule Charter, Chapter IV.C, City Secretary, Section 4.21 states that a City Secretary shall be appointed to perform certain duties; and, Whereas, an Acting City Secretary shall be designated to perform the duties of the City Secretary in her absence or disability; and, Whereas, the duties of the Acting City Secretary shall include the recording of minutes of all meetings the City Secretary may be required to attend, the posting of necessary agenda, the affixing of the City Seal to instruments requiring said seal, and any other duties that may be required of the City Secretary by the City Council; now, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: Section 1. All of the findings in the preamble are found to be true and correct and the City Council hereby incorporates said findings into the body of this resolution as if copied in its entirety. Section 2. The City Council hereby appoints the Deputy City Secretary to serve as the Acting City Secretary in the event of her absence or disability. Section 3. This resolution shall become effective after its passage and approval by the City Council. PASSED AND APPROVED THIS THE 17" DAY OF DECEMBER 2002. Farwell City Secretary RESOLUTION APPROVING THE DENTON COUNTY CLERK ' BECOME AND SERVE AS THE LOCAL REGISTRAR FOR THE VITAL STATISTICS RECORDS OF THE CITY OF SOUTHLAKE, TEXAS WHEREAS, Title 3, Section 191.023 of the Texas Health and Safety Code, Vital Statistics, provides for the consolidation of County and Municipal Maintenance of Birth and Death Records; and WHEREAS, The Official to "whom the duties would be transferred, being the County Clerk, has attested in writing that she has sufficient resources to assume those duties; and WHEREAS, The City of Southlake is supportive of the transfer of duties as Registrar of birth and death records to the Denton. County Clerk; and WHEREAS, The consolidation only affects the City of Southlake and the County of Denton effective October 15, 2002; and WHEREAS, ` The Denton County Clerk currently has a computer link with the State Registrar in order to provide birth records of individuals born in other counties in the State of Texas as a convenience to the taxpayers of Denton County; and WHEREAS, The citizens of Denton County would be better served by having all birth and death records from the City of Southlake maintained in, same location as county birth and death records by transferring the duties relating to the maintenance of birth and death records to the Denton County Clerk; NOW, THEREFORE, BE IT RESOLVED by the Commissioners Court of Denton County, Texas, meeting in this regular, session on Tuesday, October 08, 2002, that effective October 15, 2002, the Denton County Clerk is hereby designated Vital Statistics Registrar for the City of Southlake with the responsibility of receiving, registering'and maintaining a record of all births" and deaths occurring within the city limits of the City of Southlake, Texas, Denton County portion, and the transfer of such responsibilities and records to the Denton County Clerk is hereby authorized.
