2002-018RESOLUTION NO. 02-018 OFRC ECORD A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR THE SALES AND SERVICE OF NEW AUTOMOBILES OR TRUCKS, AND FOR THE SALES AND SERVICE OF USED AUTOMOBILES OR TRUCKS, ON PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS, BEING LEGALLY DESCRIBED AS LOT 11, BLOCK B, COMMERCE BUSINESS PARK, MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED CONCEPT PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for the sales and service of new automobiles, trucks, or motorhomes, and for the sales and service of used automobiles, trucks, or motorhomes has been requested by a person or corporation having a proprietary interest in the property zoned as I-1" Light Industrial District; and, WHEREAS, in accordance with the requirements of Section 45.1(23) and Section 45.1 (24) of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for the sales and service of new automobiles or trucks, and for the sales and service of used automobiles or trucks, on the property being legally described as Lot 11, Block B, Commerce Business Park, more fully and completely described in Exhibit "A", and as depicted on the approved Concept Plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: 1. removing the sell of RV / Motorhomes as an allowed use. 2. requiring the storage and display of vehicles indoors only. 3. granting a term of three years to coincide with the initial lease of the facility. Drive `A' needs to be 150 feet from the Crooked Lane intersection. The plan shows 75 feet of spacing. (A variance has been requested) 2. Submit a letter to request the following variances from the bufferyard requirements found in Section 42 of the Zoning Ordinance: Although provided on the plan, a letter is required. a) Bufferyards along lot lines internal to the development shall not be required. b) A 10' -Type `F-1' bufferyard shall be required along the northeast property line old Crooked Lane). A Type `F--2' is required next to a residential land -use designation. C) A screening hedgerow (Nellie R. Stevens Holly, Foster Holly) may be substituted for a screening fence in bufferyards Type `F-1'. Submit a letter to request a variance from the front building setback as required for properties with residential adjacency as defined in Section 43 of the Zoning Ordinance. Lots that directly abut lots or tracts zoned in a residential classification shall maintain a minimum front yard setback of 40 feet, a minimum side yard setback of 25 feet, and a minimum rear yard setback of 25 feet. Case No. ZA 02-018 Provide written justifications for all variances being requested. All variance requests must be documented in writing and fully justified. Staff recommends submitting a single letter outlining all variances being requested with justifications for each. INFORMATIONAL COMMENTS The applicant should be aware that prior to issuance of a building permit a Plat must be processed and filed in the County Plat Records, and a site plan, landscape plan, irrigation plan, and building plans, must be submitted for approval and all required fees must be paid. This may include but not be limited to the following fees: Park Fee, Perimeter Street Fee, Water & Sewer Impact and Tap Fees, and related Permit Fees. This review is based on the "I-1" Zoning District Regulations. This site falls within the applicability of the residential adjacency standards as amended by Ordinance 480 -CC, Section 43, Part III "Residential Adjacency Standards". Although no review of the following issues is provided with this concept plan, the applicant must evaluate the site for compliance prior to submittal of the site plan. A Site Plan must be submitted and approved by the Planning and Zoning Commission and City Council prior to issuance of a building permit. Note that these issues are only the major areas of site plan review and that the applicant is responsible for compliance with all site plan requirements: Masonry requirements per §43.13a, Ordinance 480, as amended and Masonry Ordinance No. 557, as amended. Roof design standards per § 43.13b, Ordinance 480, as amended Mechanical Equipment Screening per § 43.13c, Ordinance 480, as amended. Vertical and horizontal building articulation (required on all building facades) per 43.13d, Ordinance 480, as amended. Building setback standards as per § 43.13h and as shown in exhibit 43-E, Ordinance 480, as amended. Spill-over lighting and noise per §43.131 and §43.13j, Ordinance 480, as amended. Off-street parking requirements per §35, Ordinance 480, as amended. All areas intended for vehicular use must be of an all weather surface material in accordance with the Ordinance No. 480, as amended. Screening as per §39.4, Ordinance 480, as amended.
