2000-033City of Southlake, Texas RESOLUTION NO 00-33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, DETERNIINING THE NECESSITY OF ACQUIRING 14 ACRES OF LAND WITHIN THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS THAT: SECTION 1 The City Council of the City of Southlake, Texas; hereby determines that a public necessity exists that requires acquisition of 14 acres of land, more or less, described in Exhibit "A" and depicted on Exhibit B" attached hereto and made a part hereof for all purposes. SECTION 2 The City council hereby finds that reasonable good faith negotiations have occurred with the property owner in an attempt to purchase the property and that a fair market value has been offered to the property owner for the property, which was rejected by the property owner. SECTION 3 The City Attorney is hereby authorized and directed to commence eminent domain proceedings in order to acquire the property. SECTION 4 The City Manager and City Attorney are authorized to comply with the statutes of the State of Texas with reference to the necessary legal prerequisites existing in or relating to the exercise of eminent domain to appropriate said property for the purpose of expanding existing park land. SECTION 5 The owner claiming an interest in said property is W. Ralph and Linda S. Evans whose mailing address is 315 Shady Oaks Drive, Southlake, Texas 76092.
