A RESOLUTION OF THE CITY OF SOUTHLAKE, TEXAS, CALLING FOR
A RUN-OFF ELECTION TO BE HELD ON JUNE 1, 1996 FOR THE
OFFICE OF MAYOR AND COUNCILMEMBER PLACE 4; ESTABLISHING
PROCEDURES FOR CONDUCT OF THE ELECTION; AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, an election was held on Saturday, May 4, 1996 to elect officers to fill
offices on the governing body of the City of Southlake; and
WHEREAS, the city charter and Sec. 11 of Art. 11 of the Texas Constitution require
that a candidate must receive the majority of all votes cast in order to be elected to office;
and
WHEREAS, no candidate received the votes necessary to be elected to the office of
Mayor or Councilmember Place 4.
WHEREAS, Section 2.025 of the Election Code (the "Code") requires that the run-off
election be held not earlier than the twentieth or later than the thirtieth day after the date
the final canvas of the main election is completed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS, THAT:
Section 1. Run-off Election Called. A run-off election shall be held in the City
of Southlake, Texas, on Saturday, June 1, 1996, at which officers for Mayor and
Councilmember Place 4 shall be elected.
Section 2. Candidates. The candidates for the run-off election shall be the
candidates who received the highest and second highest number of votes for the offices of
Mayor and Councilmember Place 4 in the main election held on May 4, 1996, in accordance
with Section 2.023 of the Code. The mayor shall certify in writing the candidates eligible for
placement on the run-off election ballot and shall deliver the certification to the city
secretary.
Section 3. Terms. The candidate receiving the majority of votes for the office of
Mayor shall serve the remaining one (1) year of a three (3) year term expiring May 1997.
The candidate receiving the majority of votes for the office of Councilmember Place 4 shall

serve the remaining two (2) years of a three (3) year term ending May 1998.
Section 4. Polling Places. The polling place for the run-off election shall be
Johnson Elementary School, 1301 North Carroll Avenue, Southlake, Texas, 76092. The polls
shall be open from 7:00 a.m. to 7:00 p.m. on election day, in accordance with and pursuant
to the requirements of the Code.
Section 5. Anvointment of Election Judge and Alternate Election Judge. The
following named individuals are hereby appointed to serve as Presiding Election Judge and
Alternate Presiding Election Judge, respectively, at the election:

Section 6. Publication and Postine of Notice of Election.. Notice of the election
shall be published twice in the newspaper no later than May 22, 1996 in accordance with the
provisions of the Code. Additionally, notice shall be posted no later than May 17, 1996, in
the regular place for posting notice of meetings of the city council of the city, and shall
remain posted continuously through election day, June 1, 1996.
Section 7. Earlv Votina.
a. Early Voting by personal appearance shall be conducted between the
hours of 8:00 a.m. and 5:00 p.m. on each day which is not a Saturday, Sunday, or an
official State Holiday, beginning on May 20, 1996, which is the earliest practicable
date, and continuing through May 28, 1996.
b. Early Voting by personal appearance shall be conducted at the office
of the city secretary, 1725 E. Southlake Boulevard, Southlake, Texas, 76092. The city
secretary shall serve as early voting clerk. Applications for early voting by mail shall
be delivered to the city secretary at the same address not later than 5:00 p.m., Friday,
May 24, 1996.
C. Early Voting, both by personal appearance and by mail, shall be by
paper ballots and shall be canvassed by the Early Voting Ballot Board, which is

hereby created. The Election Judge and Alternate Election Judge appointed herein
shall serve as the Presiding Officer and Alternate Presiding Officer respectively of the
Early Voting Ballot Board.
Section 8. Delivery of Returns. In accordance with the Code, immediately after
the closing of the polls on the day of the election, the election officers named in this
resolution shall make and deliver the returns of the election in triplicate as follows: one
copy shall be retained by the Presiding Judge; one copy shall be delivered to the mayor of
the city; and one copy of the returns together with the ballot boxes and all election supplies
shall be delivered to the city secretary. All election records and supplies shall be preserved
by the city secretary in accordance with the Code.
Section 9. Effective Date. This resolution shall be effective upon its adoption.
