RESOLUTION NO. 93-44
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
SUBMIT AN APPLICATION TO THE FEDERAL
COMMUNICATIONS COMMISSION FOR CERTIFICATION OF
THE CITY TO REGULATE CABLE RATES FOR BASIC
SERVICE AND TO REQUEST THE FCC TO REGULATE
NON -BASIC CABLE RATES; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Federal Communications Commission ("FCC") has
determined that rates charged subscribers for cable television
service are excessive and in many cases unreasonable and pursuant
to the Cable Television Consumer Protection and Competition Act of
1992, has adopted rules establishing a process for local regulation
of cable rates for basic service; and
WHEREAS, in order to assure that the City's citizens have the
advantage of the new federal law and are required to pay only the
most competitive rates for their cable television service; and
WHEREAS, the City must act expeditiously to initiate its
regulation of basic cable rates and to seek FCC regulation of other
cable rates; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS:
SECTION 1. That the city manager is authorized to submit, at
the earliest possible time, an application to the FCC for
certification of the City to regulate basic cable rates. In
addition the city manager shall file with the FCC, a request that
the FCC regulate non -basic cable rates.
SECTION 2. That this resolution shall take effect from and
after its passage, and it is accordingly so resolved.
