1993-003City of Southlake, Texas RESOLUTION NO. 93-03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, OPPOSING THE USE OF LEGISLATIVE INITIATIVE TO DIMINISH LOCAL HOME RULE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake by Resolution No. 89-66 of the Southlake City Council, passed and approved the 21st day of November 1989, encouraged the Dallas/Fort Worth International Airport and the cities neighboring the airport to continue to plan for the compatibility of the airport with the cities; and WHEREAS, the City of Southlake recognizes the continued compatibility between Dallas/Fort Worth International Airport and the cities in which the airport is situated is essential to the continued tranquility and economic prosperity of the airport, its neighboring cities, the region, and the State; and WHEREAS, the Dallas/Fort Worth International Airport Board has proposed a legislative initiative to amend the Texas Municipal Airports Act to grant the Dallas/Fort Worth International Airport Board authority to develop, zone, and regulate land use, and to acquire property through eminent domain proceedings including public roads and streets, within the municipal corporate boundaries of any city in which the Dallas/Fort Worth International Airport is situated; and WHEREAS, the Dallas/Fort Worth International Airport Board has represented that the Board's legislative initiative is not an initiative against home -rule authority; and WHEREAS, the initiative proposed by Dallas/Fort Worth International Airport will diminish the sovereign rights and authority of the cities in which the airport is situated, rights and authority granted all home -rule municipalities by Article XI, Section 5, of the Texas Constitution; and WHEREAS, precedential action by the Legislature to limit home - rule authority will not only diminish local home -rule of the people in the cities in which Dallas/Fort Worth International Airport is situated, but can lead to the potential further erosion of municipal home -rule authority throughout the state when special interest groups are dissatisfied with local home -rule; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: Section 1. The City of Southlake continues to encourage resolution of the differences between Dallas/Fort Worth International Airport, the cities in which the airport is situated, and the other neighboring cities. City of Southlake, Texas Resolution No. 93-03 Page 2 Section 2. The City of Southlake encourages the State Legislature to assure equal home -rule authority to all Texas home - rule municipalities. Section 3. The City of Southlake opposes the use of legislative initiative by special interests to diminish local home -rule authority. Section 4. This Resolution shall take effect immediately.
