RESOLUTION NO.90-44
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS, AUTHORIZING THE MAYOR TO
EXECUTE DOCUMENTS RELATED TO THE ABANDONMENT OF
EASEMENTS IN DOVE ESTATES SUBDIVISION. PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City of Southlake was granted an easement
and right-of-way upon and across the properties as described in
Exhibits "A" "B" "C" "D" and "E" attached hereto; and
WHEREAS, it was expressly agreed and understood that the
easement, rights, and privileges conveyed to the City by the
Grantee was limited to the installation and operating of sewer
lines for certain adjacent lots; and,
WHEREAS, the properties encumbered by the easements do
not have existing lateral lines; and,
WHEREAS, the easements are no longer required for the
lots in question due to the availability of the sewer system; and,
WHEREAS, the dedicated easements expressly provide that
the easements, rights, and privileges granted under the easement
shall terminate upon the availability of the sewer system; now,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, THAT:
Section 1. That the above premises are found to be true and
correct and are incorporated into the body of this Resolution as
if copies in their entirety.
Section 2. That the Mayor be authorized and directed to execute
the easements attached hereto in Exhibit "A", "B", "C", "D", and,
Ell.
