1985-043r 0 RESOLUTION NO. 85-43 A RESOLUTION GRANTING A VARIANCE OF BUILDING SET BACK LINES ON TWO SIDES OF A CERTAIN TRACT OF LAND OWNED BY ROBERT GEORGE LYFORD, SAID VARIANCE BEING PROVIDED TO ' COMPLY WITH A CONTRACTUAL OBLIGATION OF THE CITY OF SOUTHLAKE. WHEREAS the City of Southlake, Texas by action approved by the City Council of said City entered into a contract for the purchase of a.tract or parcel of land from Robert George Lyford, such tract or parcel being described in the below and said contract having been entered and executed by the City of Southlake in January 1985; and WHEREAS, the City of Southlake, Texas in said contract agreed as a condition and consideration for the purchase of the land described in such aforesaid contract and in this Ordinance to waive the side and rear yard requirements for the portion of the Seller's property(Robert George Lyford) remaining after the conveyance of a portion thereof to the City of Southlakeas to any side or rear of such property or tract adjacent to the property acquired by the City and that the City of Southlake would present a waiver or variance to the Zoning Ordinance regarding such side yard requirements to the Seller(Robert George Lyford); and WHEREAS the purchase of such land was closed and such tract of land was conveyed to the City of Southlake on February 22, 1985,; and WHEREAS the City Council of the City of Southlake, Texas desires to hereby consider and grant the variance or waiver set forth in said contract and agreed to by the City of Southlake as to a portion of property remaining and owned by Robert George -Lyford after the severance thereof of the portion conveyed to the City of Southlake, Texas. VOL 8396 PGCE 224 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS THAT: I. A variance is hereby granted from the building set back requirements of Ordinance 261 (Zoning Ordinance) for the below described property waiving such building set back lines for the side and rear yard areas of such property which abutt and are adjacent to the property conveyed to the City of Southlake, Texas, by Robert George Lyford and which would commonly be referred to as the east and south sides of the following described tract: PROPERTY DESCRIPTION Part of the T. Easter Survey, Abstract No. 474, situated about 17 miles north 46 degrees east from the courthouse in Tarrant County, Texas; and embracing a portion of the 7-10/100 acres tract described in the deed to R.G. Lyford recorded in Volume 2202, Page 473 of the Tarrant County Deed of Records. Commencing at 3/4" pipe for the northeast corner of the said 7- 10/100 acres tract from which the northwest corner of said Easter Survey bears by deed call north 72 degrees -30 minutes west 611-64/100 feet; south 3 degrees -27 minutes west 30-8/10 feet and north 89 degrees -26 minutes west 110-60/100 feet; and then run, north 72 degrees -17 degrees -17 minutes -24 seconds west, along the north line of said 7-10/100 acres tract and the south line of Grapevine -Keller Road, 21 feet to a 5/8" iron for the northeast and beginning corner of the tract being described. Thence south 665-53/100 feet to a 5/8" iron. THENCE south 89 degrees -36 minutes west 180 feet to a 5/8" iron. THENCE south 200 feet to a 5/8" iron in the south line of said 7-10/100 acres tract. THENCE south 89 degrees -36 minutes west, along the south line of said 7-10/100 acres tract, 138-6/10 feet to a 5/8" iron for the southwest corner of said 7-10/100 acres tract. THENCE north no degrees -no minutes 53 seconds west, along the west line of said 7-10/100 acres tract, 969-57/100 feet to a 1/2" iron for the northwest corner of said 7-10/100 acres tract in the said south line of Grapevine -Keller Road. THENCE south 72 degrees -17 minutes -24 seconds east, along the north line of said 7-10/100 acres tract and said south line of Road, 334-7/10 feet to the place of beginning and containing 5- 887/1000 acres. II. The City of Southlake shall hereof be estopped from ever requiring a side yard or rear yard building line for the east side and south side, respectively, of the property described in Paragraph I above, as a result of the granting of this variance. VOL 8396 PAGE 225 III. That this variance be recorded, if allowable, in the Tarrant County Deed Records to reflect the variance hereby granted for the said property described herein.
