1985-010RESOLUTION NUMBER 85-10 Whereas the City Council of the City of Southlake, Texas previously authorized Mayor Lloyd 0. Latta, Jr., to locate a site suitable for use by such City in connection with its water system as a site for an above ground water storage facility and for other uses to be determined by the City in the future; Whereas, Mayor Lloyd 0. Latta, Jr., located such a tract of land, entered a contract for the purchase thereof and has closed such purchase in accordance with such contract; and Whereas, the City Council for the City of Southlake desires to express its consent and ratification to such purchase; and Whereas, the City Council of the City of Southlake, Texas, finds it to be expedient for the City to obtain a release of an existing deed restriction set forth in a deed dated September 7, 1982, for a 1.75 acre tract out of the R. D. Price Survey, Abstract No. 1207, prohibiting the construction of any water tower on said property in excess of 40 feet in height; Now Therefore, Be It Resolved, by the City Council of the City of Southlake, Texas that the purchase of a tract of land containing 1.22 acres, more or less out of the Thomas Easter Survey, Abstract Number 474, located in Southlake, Tarrant County, Texas for a purchase price of $65,000.00 for the use by such City for any purpose for which it desires including the construction of above ground water storage facilities, but excluding outside storage, which purchase occurred on February 21, 1985, be in all things approved by the City Council of the City of Southlake, Texas and that all expenditures incurred in connection with the purchase of said tract for closing costs and other necessary fees also be authorized and approved and that the said act of Mayor Lloyd 0. Latta, Jr. in purchasing said tract and in closing upon said purchase be in all things approved and ratified by the City of Southlake, Texas, and it is, I Further, Resolved by the City Council of the City of Southlake, Texas, that the payment to Dorthea Christine McCreary Ramsay in an amount of $3,000.00 to obtain a release of a deed restriction prohibiting the construction of any water tower in excess of 40 feet in height upon a 1.75 acre tract of land purchased from said person on or about September 7, 1982, be ratified and approved as an act of the City of Southlake, Texas, for all purposes. Adopted this day of March, 1985 upon a vote of the City Council of the City of Southlake, Texas, ayes, Q nayes,, and P abstaining.
