MEMBERS ABSENT: None. STAFF PRESENT: Sr. Director of Planning and Development Services Ken Baker; Deputy Director of Planning & Development Services Dennis Killough; Director of Economic Development & Tourism Daniel Cortez; and Commission Secretary Lydia Ruiz. WORK SESSION: 1. CALL TO ORDER: 2. Executive Session: Pursuant to the Open Meetings Act, Chapter 551, Texas Government Code, Sections 551.071. Refer to posted list attached hereto and incorporate herein. Executive Session may be held, under these exceptions, at the end of the Regular Session or at any time during the meeting that a need arises for the Planning and Zoning Commission to seek advice from the City Attorney as to the posted subject matter of this Planning and Zoning Commission meeting. Deputy Director, Dennis Killough advised the Commission of a Capital Improvements Advisory Committee (CIAC) meeting scheduled for February 18, 2021 and meeting will begin at 5:30 p.m., prior to Work Session. 4. CHAIRMAN KUBIAK COMMENTS Chairman Kubiak made several announcements to the public and Commission. • Announcement of Amy Torres-Lepp resignation to the Planning and Zoning Commission. • Move item 10 before item 6 on tonight’s agenda and keep the remainder of the agenda in order. • Welcomed new commission member, Austin Reynolds to the Planning and Zoning Commission and Sign Board. CONSENT AGENDA: 5. CONSIDER: APPROVAL OF THE MINUTES FOR THE PLANNING AND ZONING COMMISSION MEETING HELD ON JANUARY 21, 2021. A motion was made to approve item 5, Planning and Zoning minutes from the January 21, 2021 meeting. CONSIDER: CP20-0002, ORDINANCE NO. 1161A, ADOPTING AN ADDENDUM TO THE EXISTING SOUTHLAKE 2035 ECONOMIC DEVELOPMENT MASTER PLAN, AN ELEMENT OF THE SOUTHLAKE 2035 COMPREHENSIVE PLAN. PUBLIC HEARING Director of Economic Development & Tourism Daniel Cortez did a brief summary on item 6, it was formally presented during Work Session; questions were asked. A motion was made to approve item 7, subject to the staff report dated January 29, 2021, and further subject to the plan review summary #2 dated January 29, 2021; and noting the Applicant’s willingness to work with Staff prior to City Council to address the potential for future fencing such that there would be a setback of 10-feet, that any gates in the future might be setback 25-feet, and noting the request that any future fence be of material such as wrought iron. PUBLIC HEARING Deputy Director, Dennis Killough presented item 9; questions were asked. Applicant – Warren Packer, 7810 Constance Avenue, Frisco, Texas, came forward to speak and answer questions. Chairman Kubiak opened the public hearing. No one came forward. Chairman Kubiak closed the public hearing. A motion was made to approve item 9, subject to the staff report dated February 4, 2021, and subject to the revised concept plan review summary #2 dated February 4, 2021; specifically noting the approval of variance #2 for the driveway ordinance, and specifically noting disapproval of variance #1 request related to the sidewalk ordinance; also noting the Applicant’s willingness to work with Staff prior to City Council with respect to identifying any future fencing as being setback 10-feet, as well as any future driveways being setback 25-feet, and any fencing along Dove Road roadway being of material of wrought iron for any future fencing; and noting the Applicant’s indication that they will use a circular driveway and to bring that plan to City Council; and finally noting that due to this having a preexisting lot with no future subdivision plans that Planning and Zoning finds this request is consistent with the land use designation.
