WHEREAS, the City of Southlake IS a home rule city acting under its charter adopted by the electorate pursuant
to Artlck XL Section '\ of the Texas Constitution and Chapter 9 of the Local Govemment Code; and
WHEREAS, the City Council of the City of Southlake deems it necessary to adopt this ordinance providing
1111l11mUill standards to safeguard the health, property, and welfare of the citizens of Southlake by regulating and
controllll1g the use, occupancy, maintenance, repair, design, construction and quality of materials for residential buildings
and structures within the City.
WHEREAS, beginning in the summer of2003, NCTCOG's Regional Codes Coordinating
Committee (RCCC) and its four advisory boards conducted 26 open review meetings over a 10-
month period to review the 2003 editions of the International Codes and to develop regional
amendments. Their review and recommendations were completed and endorsed by NCTCOG's
Executive Board in March 2004. Now NCTCOG encourages jurisdictions in North Central Texas to
adopt the 2003 International Rcs[(lcntial Codcfor Onc- and nvo-FamiZv Dwellings along with its
respective regional amendments with an effective date of July 1,2004:
NOW, THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

SECTION 1
That the International ResidentIal Code for One- and Two-Family Dwellings, 2003 Edition, published by the
Internatinnal Code Council, including the standards referenced therein. including Appendix Chapters A, B, C, E, G, Hand
.I arc hereby adopted as the Residential Building Code of the City of Southlake regulating the erection, construction,
enlargement. alteration. repair. moving, removal, demolition, conversion, occupancy, equipment, use, height, area and
lllall1teml11ce of all one- and two-family dwellings, multiple single-family dwellings (townhouses) and their accessory
structures in the City of Southlake. True and correct copies of these documents are attached as Exhibit "A."
SECTION 2
That the 2003 International Residential Code, as adopted herein, is hereby amended as provided)n Exhibit "B"
incnrporated herein and attached hereto for all purposes of this ordinance. The City of Southlake, Texas may from time to
time determine that additional local modifications to the Building Code are necessary and approprIate to meet the ul1lque
needs of the City of Southlake, Texas. To effectuate these local modifications, the City Council shall enact individual
ordlllatll"es amending this Ordinance, tìIlly setting forth the change to be made in the Residential Building Code. Upon
adoption. copies of these amendments shall be attached to Exhibit "B" to this Ordinance.
SECTION 3
fhe materIal contained III Exhibit "A" to this ordinance shall not be included in theJormal municipal codification of
ordinances, but shall be maintained as a public record in the office of the City Building Official and will be available for
public lI1spection and copying during regular business hours
SECTION 4
fhis ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas, except where the
provisIons of this ordinance are in direct conf1ict with the provisions of such ordinances, in which event the conf1icting
prO\lslons of such ordinances are hereby repealed.
SECTION 5
It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and
sectIOns of this ordinance are, severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be
dec lared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 6
Any person, firm or corporation who violates, disobeys, omits. neglects or refuses to comply with or who resists
the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($
2.0OCLOO) for all violations involving zoning, fire safety or public health and sanitation, including dumping or refuse, and
shall bc fined not more than five hundred dollars ($500) for all other violations of this ordinance each day that a violation
IS permItted to exist shall constitute a separate offense.
SECTION 7
All rights and remedies of the City of Southlake are expressly saved as to any and all violations ofthe provisions
of any ordinances affecting the regulation and control of the use, occupancy, maintenance, repair, design, construction and
quality oi'materials for buildings and structures within the City which have accrued at the time of the effective date of this
ordlllance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court
or not. under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition
by the lourts.
SECTION 8
fhe City Secretary of the City of Southlake is hereby authorized to publish this ordinance in book or pamphlet
jorlll 1'01 general distribution among the public, and the operative provisions of this ordinance as so published shall be
admissIble in evidence in all courts without further proof than the production thereof.
SECTION 9
The City Secretary of the City of Southlake is hereby directed to publish in the official newspaper of the City of
South]ake, the caption, penalty clause, publication clause and_effective date of this ordinance one time within ten days
after passage of this ordinance, as requIred by Section 3.13 of the Charter of the City of Southlake.
SECTION 10
This ordinance sha1l be in fu1l force and effect from and after its passage and publication as required by law, but
not sonner than September 30 2004.

Amendments to the
2003 International Residential Code
The following sections, paragraphs, and sentences of the 2003 International Residential Code for One- and
Two-family Dwellings are hereby amended as follows:
(Standard type is text from the IRC. Underlined type is text inserted. Lined through type is deleted text from

given to aid in understanding of the code.
Section R101.1; Insert city name as follows:
R1 01.1 Title. These regulations shall be known as the Building Code of The City of South lake, Texas
hereinafter referred to as "this code."
Section R102.4; change to read as follows:
R102.4 Referenced codes and standards. The codes, when specifically adopted, and standards referenced
in this code shall be considered part of the requirements of this code to the prescribed extent of each such
reference. Whenever amendments have been adopted to the referenced codes and standards, each
reference to said code and standard shall be considered to reference the amendments as well. Any reference
made to NFPA 70 or the ICC Electrical Code shall mean the Electrical Code as adopted. Where differences
occur between provisions of this code and referenced codes and standards, the provisions of this code shall
apply

Section R105.1, Add the following sentence:
105.1 Required. Any owner or authorized agent who intends to construct, enlarge, alter, repair, move,
demolish, or change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove,
convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is regulated by
this code, or to cause any such work to be done, shall first make application to the building official and obtain
the required permit. For excavation or qradinq permits see IBC appendix chapter J as adopted.
(Reason: to make it clear that grading is regulated under the IBC even if on a residential lot.)
Section R105.2, Under electrical; change as follows:
Electrical. An electrical permit shall not be required for the followinq:
1. Portable motors or other portable appliances enerqized by means of a cord or cable havinq an attachment
pluq end to be connected to an approved receptacle when that cord or cable is permitted by the Electrical
Code.
2. Repair or replacement of fixed motors, transformers or fixed approved appliances of the same type and
ratinq in the same location.
3. Temporary decorative liqhtinq.
4. Repair or replacement of current-carryinq parts of any switch, contactor or control device.
5. Reinstallation of attachment pluq receptacles, but not the outlets therefor.
6. Repair or replacement of any overcurrent device of the required capacity in the same location.
7. Tapìnq joints.
8. Removal of electrical wirinq.
9. Electrical wirinq, devices, appliances, apparatus or equipment operatinq at less than 25 volts and not
capable of supplyinq more than 50 watts of enerqy. ...
10. Low-enerqy power, control and siqnal circuits of Class II and Class III as defined In the Electrical Code.

Section R105.3.1.1 revise as follows:
§RR105.3.1.1 Substantially improved or substantially damaged existing buildings in are~s 'prone to
flooding. For applications for reconstruction, rehabilitation, addition, or the improvement of existing buildings
or structures located in an area prone to flooding as established by Ordinance 641, the building official shall
examine or cause to be examined the construction documents and shall prepare a finding with regard to the
value of the proposed work. Construction in such areas shall only be permitted as authorized by such
ordinance.

Section 108.6; add.
108.6 Re-inspection Fee. A fee as established by city council resolution may be charged when:
1. The inspection called for is not ready when the inspector arrives;
2.The temporary electrical pole does not have a building permit clearly posted;
3.No building address or permit card is clearly posted;
4.City approved plans are not on the job site available to the inspector;
5.The building is locked or work otherwise not available for inspection when called;
6.The job site is red-tagged twice for the same item;
7.The original red tag has been removed from the job site and/or,
8.Violations exist on the property including failure to maintain erosion control, trash
control or tree protection.
Any re-inspection fees assessed shall be paid before any more inspections are made on
that job site.
(Reason: This fee is not a fine or penalty but is designed to compensate for wasted time and trips
when inspections are called for when not ready.)
Section 108.7; add.
108.7 Investigation Fee. Work without a permit.
108.7.1 Investigation. Whenever work for which a permit is required by this code has been
commenced without first obtaining a permit, a special investigation shall be made before a
permit may be issued for such work.
108.7.2 Fee. An investigation fee, in addition to the permit fee, shall be collected whether or
not a permit is subsequently issued. The investigation fee shall be equal to the amount of
the permit fee required by this code or the city fee schedule as applicable. The payment of
such investigation fee shall not exempt the applicant from compliance with all other
provisions of either this code or the technical codes nor from penalty prescribed by law.
(Reason: This fee is not a fine or penalty but is designed to compensate for wasted time and to
remove incentive to attempt to evade permits and code compliance. Language taken from former
Uniform Administrative Code.)
Section R109.1.3; change to read as follows:
R1 09.1.3 Floodplain inspections. For construction permitted in areas prone to flooding as established by
Ordinance 641, upon. . . {bulk of section unchanged} . . . construction, the building official may sRaU require

(Reason: Confirmation of elevation is left to local codes.)
Section R110 (R 11 O. 1 through R110.4); delete.
(Reason: Issuing CO's for residences is not a common practice in the area.)
Section 112; delete entirely and substitute the following:
SECTION 112 BOARD OF APPEALS
112.1 General. In order to hear and decide appeals of orders, decisions or determinations made by the
buildinq official relative to the application and interpretation of this code, there shall be and is hereby created a
board of appeals. The Buildinq Board of Appeals as established by ordinance 622, as amended, shall
constitute the Board of Appeals referenced in this code.
112.2 Limitations on authority. An application for appeal shall be based on a claim that the true intent of this
code or the rules leqally adopted thereunder have been incorrectly interpreted, the provisions of this code do
not fully apply, or an equally qood or better form of construction is proposed. The board shall have no authority
to waive requirements of this code.

Section R202; add definition of "Naturally durable wood" as follows:
NATURALLY DURABLE WOOD. The heartwood of the followinq species with the exception that an
occasional piece with corner sapwood is permitted if 90 percent or more of the width of each side on which it
occurs is heartwood.
Decav resistant. Redwood, cedars. black locust and black walnut.
Termite resistant. Redwood and Eastern red cedar.

Section R302. 1; add a second exception as follows:

.L Tool and storage sheds, playhouses and similar structures exempted from permits by Section
R105.2 are not required to provide wall protection based on location on the lot. Projections beyond
the exterior wall shall not extend over the lot line.
2. Open metal carport structures may be constructed within zero (0) feet of the property line without
fire-resistive or openinq protection when the location of such is approved as required by other
adopted ordinances.

Section R303.3, exception; change to read as follows:
Exception: The glazed areas shall not be required where artificial light and a mechanical ventilation
system, complyinq with one of the followinq, are provided.

LIs) for continuous ventilation. Ventilation air from the space shall be exhausted directly to the

R313.3.1 Standards. Fire protection systems shall comply with the
appropriate International euildinQ Code standards and National Fire

R 320.1.1.1 RJ20.1.1 Quality Mark. Lumber and plywood required to be pressure
preservatively treated in accordance with R324.1 shall bear the quality mark of an approved
inspection agency which maintains continuing supervision, testing, and inspection over the
quality of the product and which has been approved by an accreditation body which complies
with the requirements of the American Lumber Standards Committee treated wood program.
R320.1.1.2 Field treatment. Field cut ends, notches and drilled holes of pressure
preservativelv treated wood shall be retreated in the field in accordance with AWPA M4.
Revise sections R320.2 through R320.4 as follows:
R320.2 R320.1.2 Chemical soil Pesticide treatment. The concentrations, rate of application
and treatment methods of the termiticide shall be consistent with and never less than the
termiticide label. Pesticide treatment shall be provided usinq methods approved by the
Environmental Protection Aqencv and the Texas Structural Pest Control Board.
R320.1.3 Physical Barriers. Physical barriers shall be installed as
recoqnized by Texas Structural Pest Control Board.

(Reason: To make the IRC decay protection requirements consistent with the IBC and consistent
with similar provisions that were contained in the UBC. Reference is added in R320 for treating of
field cuts in compliance with AWPA M4. This is consistent with the requirements in R319. However,
In practice almost all preservatively treated wood in the local area is southern pine and Section 6 of
M4 says that field treatment of softwood species such as southern pine isn't necessary to provide a
good service life.
The revisions to R320 are intended to make the section read better and to provide guidance in
proper methods of termite protection.)
Section R323. 1; change to read as follows:
R323.1 General. Buildings and structures, when permitted to be constructed in flood hazard areas. . . {bulk of
section unchanged}. . shall be designed and constructed as required in accordance with the provisions
contained in this section or by other local provisions as applicable.

Section R602.10.5; add the following exception and figure:
Exception: Vertical wall seqments in the first of one- or first of two-story buildinqs next to qaraqe openinqs
shall be permitted to have a 6: 1 heiqht-to-width ratio (with heiqht beinq measured from top of header to sill
plate) when constructed in accordance with the followinq provisions. Each panel shall have a lenqth of not
less than 16 inches (406 mm) and a heiqht of not more than 10 feet (3048 mm). Each panel shall be sheathed
on one face with a sinqle layer of 3/8-inch-minimum-thickness (9.5 mm) wood structural panel sheathinq nailed
with 8d common or qalvanized box nails in accordance with Fiqure R602.1 0.5(2). The wood structural panel
sheathinq shall extend up over the solid sawn or qlued-Iaminated header and shall be nailed in accordance
with Fiqure R602.1 0.5(2). The header shall extend between the inside faces of the first full-Ienqth outer studs
of each panel. The clear span of the header between the inner studs of each panel shall be not less than six
feet (1829 mm) and not more than 18 feet (5486 mm) in lenqth. A strap with an uplift capacity of not less than
1000 pounds (454 kq) shall fasten the header to the side of the inner studs opposite the sheathinq. Two
anchor bolts shall be installed in accordance with Section R403.1.6, and plate washers shall be a minimum of
2 Inches by 2 inches by 3/16 inch (51 mm by 51 mm by 4.88 mm) thick and shall be used on each bolt. This
exception is only permitted in Seismic Desiqn Cateqories A-C.

the maximum length of the exhaust duct, including any transition duct, shall be permitted to

dryer is located, a permanent identifying label shall be placed adjacent to where the exhaust
duct enters the wall. The label shall bear the words "This dryer exhaust system is equipped

manufacturer's installation instructions for such dryer are provided to the building official, the

excessive vibration but in no case qreater than 12-inches from the center of the valve. Supports shall be

P2503.5.1 Rough plumbing. DWV systems shall be tested on completion of the rough piping installation by
water or air with no evidence of leakage. Either test shall be applied to the drainage system in its entirety or in
sections after rough piping has been installed, as follows:
1. Water test. Each section shall be filled with water to a point not less than 10 feet (3048 mm) above the
highest fitting connection in that section, or to the highest point in the completed system. Water shall be held in
the section under test for a period of 15 minutes. The system shall prove leak free by visual inspection.
Shower receptors shall be tested for water tiqhtness by fillinq with water to the level of the rouqh threshold.
The drain shall be pluqqed in a manner so that both sides of pans shall be subjected to the test at the point
where it is clamped to the drain.
2 Air test. The portion under test shall be maintained at a gauge pressure of 5 pounds per square inch (psi)
(34 kPa) or 10 inches of mercury column (2488 Pa). This pressure shall be held without introduction of
additional air for a period of 15 minutes.
(Reason. To clarify that a water test is required for a shower receptor.)

Sections P3112.2 and3112.3 ;delete and replace with new Section 3112.2 as follows:
P3112.2 Installation. Traps for island sinks and similar equipment shall be rouqhed in above the floor and
may be vented by extendinq the vent as hiqh as possible, but not less than the drainboard heiqht and then
returninq it downward and connectinq it to the horizontal sink drain immediately downstream from the vertical
fixture drain. The return vent shall be connected to the horizontal drain throuqh a wye-branch fittinq and shall,
in addition, be provided with a foot vent taken off the vertical fixture vent by means of a wye-branch
Immediately below the floor and extendinq to the nearest partition and then throuqh the roof to the open air or
may be connected to other vents at a point not less than six (6) inches (152 mm) above the flood level rim of
the fixtures served. Drainaqe fittinqs shall be used on all parts of the vent below the floor level and a minimum
slope of one-quarter (1/4) inch per foot (20.9 mm/m) back to the drain shall be maintained. The return bend
used under the drainboard shall be a one (1) piece fittinq or an assembly of a forty-five (45) deqree (0.79
radius), a ninety (90) deqree (1.6 radius) and a forty-five (45) deqree (0.79 radius) elbow in the order named.
Pipe sizinq shall be as elsewhere required in this Code. The island sink drain, upstream of the return vent,
shall serve no other fixtures. An accessible cleanout shall be installed in the vertical portion of the foot vent.
(Reason: To clarify the installation of island venting and to provide a standard installation method for
the region. An air admittance valves installed according to section 3114 is an alternate venting
method to this section.)

AG105.2 Outdoor swimming pool. An outdoor swimming pool, including an
In-ground, aboveground or on-ground pool, hot tub or spa shall be provided
with a barrier which shall comply with the following:
1. The top of the barrier shall be at least 48 inches (1219 mm) above grade measured on the
side of the barrier which faces away from the swimming pool. The maximum vertical clearance
between grade and the bottom of the barrier shall be 2 inches (51 mm) measured on the side of
the barrier which faces away from the swimming pool. Where the top of the pool structure is above
grade, such as an aboveground pool, the barrier may be at ground level, such as the pool
structure, or mounted on top of the pool structure. Where the barrier is mounted on top of the pool
structure, the maximum vertical clearance between the top of the pool structure and the bottom of
the barrier shall be 4 inches (102 mm).
Pre-existina fences. The installation of a swimminq pool creates the requirement for the barrier
fence. A previously existinq fence would not have any status under this section because the
addition of the pool creates the hazard on which the code section is based. The one exception to
this qeneral rule is when the fence on one side of the new pool is already a pool enclosure for the
adjacent property. That fence seqment which is common to another yard with a pool is a leqal
nonconforminq pool enclosure and need not be upqraded. Any other existinq fence that is just now
becominq a pool enclosure shall comply with this section.
2. Openings in the barrier shall not allow passage of a 4-inch-diameter (102 mm) sphere.
3. Solid barriers which do not have openings, such as a masonry or stone wall, shall not contain
Indentations or protrusions except for normal construction tolerances and tooled masonry joints.
4. Where the barrier is composed of horizontal and vertical members and the distance between the
tops of the horizontal members is less than 45 inches (1143 mm), the horizontal members shall be
located on the swimming pool side of the fence. Spacing between vertical members shall not exceed
1.75 inches (44 mm) in width. Where there are decorative cutouts within vertical members, spacing
within the cutouts shall not exceed 1.75 inches (44 mm) in width.
5. Where the barrier is composed of horizontal and vertical members and the distance between the
tops of the horizontal members is 45 inches (1143 mm) or more, spacing between vertical members
shall not exceed 4 inches(1 02 mm). Where there are decorative cutouts within vertical members,
spacing within the cutouts shall not exceed 1.75 inches (44 mm) in width.
EXCEPTION: When horizontal members are part of a fence that is at least 6 feet (1830 mm) in
heiqht, the horizontal members need not be on the pool side of the barrier and the 45 inch distance
between horizontal members does not apply.
6. Maximum mesh size for chain link fences shall be a 2.25-inch (57 mm) square unless the fence is
provided with slats fastened at the top or the bottom which reduce the openings to not more than 1.75
nches (44 mm).
7. Where the barrier is composed of diagonal members, such as a lattice fence, the maximum opening
formed by the diagonal members shall not be more than 1.75 inches(44 mm).
8. Access gates shall comply with the requirements of Section AG105.2, Items 1 through 7, and shall
be equipped to accommodate a locking device. Pedestrian access gates shall open outward away
from the pool and shall be self-closing and have a self-latching device. Gates other than pedestrian
access shall h3'Je ;:¡ self 13tching devico be equipped with lockable hardware or padlocks and shall
remain locked at all times when not in use.
Where the release mechanism of the self-latching device is located less than 54 inches (1372 mm)
from the bottom of the gate, the release mechanism and openings shall comply with the following:
8.1. The release mechanism shall be located on the pool side of the gate at least 3 inches (76
mm) below the top of the gate, and
8.2. The gate and barrier shall have no opening greater than 0.5 inch (12.7 mm) within 18 inches
(457 mm) of the release mechanism.
Vehicle qates desiqned or intended to be used on a reqular basis may be automatic closinq rather
than maintained locked. Automatic qates may be opened by a key or switch (fixed or remote) but the
qate shall automatically close within one to two minutes without requirinq any additional action on the
part of the person who opened it.
9 Where a wall of a dwelling serves as part of the barrier one of the following conditions shall be met:
91. The pool shall be equipped with a powered safety cover in compliance with ASTM F1346; or
9.2. All doors with direct access to the pool through that wall shall be equipped with an alarm
which produces an audible warning when the door and its screen, if present, are opened. The
alarm shall sound continuously for a minimum of 30 seconds immediately after the door is opened
and be capable of being heard throughout the house during normal household activities. The
alarm shall automatically reset under all conditions. The alarm system shall be equipped with a
manual means, such as touchpad or switch, to temporarily deactivate the alarm for a single
opening. Such deactivation shall last for not more than 15 seconds. The deactivation switch(es)
shall be located at least 54 inches (1372 mm) above the threshold of the door; or
9.3. Other means of protection, such as self-closing doors with self-latching devices, which are
approved by the governing body, shall be acceptable so long as the degree of protection afforded
IS not less than the protection afforded by Item 9.1 or 9.2 described above
10. Where an aboveground pool structure is used as a barrier or where the barrier is mounted on top
of the pool structure, and the means of access is a ladder or steps, then:
10.1. The ladder or steps shall be capable of being secured, locked or removed to prevent access,
or
10.2. The ladder or steps shall be surrounded by a barrier which meets the requirements of
Section AG1 05.2, Items 1 through 9. When the ladder or steps are secured, locked or removed,
any opening created shall not allow the passage of a 4-inch-diameter (102 mm) sphere.
(Reason: To allow for special conditions while retaining essentially the same degree of safety.)
