PROVIDING FOR THE ADOPTION OF LOCAL AMENDMENTS THERETO; PROVIDING FOR
RECORDING OF SUCH CODE AS A PUBLIC_RECORD; PROVIDING THAT THIS ORDINANCE
SHALL BE CUMlTLATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM;
PROVIDING FOR PlIBLICATlOl\' Il\' THE OFFICIAL l\'EWSPAPER; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS. The City of Southlake, Texas is a home rule city acting under its charter adopted by the electorate pursuant
to Article XI. Section" of the Texas Constitution and Chapter 9 of the Local Government Code; and
WHEREAS. City Council of the City of Southlake deems it necessary to adopt this ordinance governing requirements for
the insta11ation and maintenance of plumbing systems inc1uding requirements for materials, in order to protect the health,
safety and welfare of the citizens ofthe City of South lake,
WHEREAS, beginning in the summer of 2003, NCTCOG's Regional Codes Coordinating Committee (RCCC) and its
four advisory boards conducted 26 open review meetings over a lO-month period to review the 2003 editions of the
InternatIOnal Codes and to develop regional amendments, Their review and recommendations were completed and
endorsed by NCTCOG's Executive Board in March 2004, Now NCTCOG encourages jurisdictions in North Central
TL'xas to adopt the 2003 International Plumbing Code along with its respective regional amendments with an effective
date of .July L 2004,
NOW. THEREFORE, BE IT ORDAINED BY THE CITY COeNCIL OF THE CITY OF SOUTHLAKE,
TEXAS:
SECTION 1
That the 111lernational Plumbing Code, 2003 Edition. published by The International Code Council, Inc., is
hereby adopted as the Plumbing Code of the City of Southlake, except for plumbing systems otherwise
regulated under the International Residential Code for One- and Two- Family Dwellings as adopted. A true
and conect copy of this Code is attached to this ordinance as Exhibit" A."
SECTION 2
That the 2003 International Plumbing Code. as adopted herein, is hereby amended as provided in Exhibit
"B" incorporated herein and attached hereto for all purposes of this ordinance. The City of Southlake may
from 1¡me to time determine that additIOnal local modifications to the 2003 International Plumbing Code
are necessary and appropriate to meet the unique construction needs of the City of Southlake, To
effectuate these modifications, the City council shall enact individual ordinances amending this ordinance
full) setting forth the change to be made In the code. Upon adoption. copies of these amendments shall
be attached to ExhibIt "B" to thIs Ordinance,
SECTION 3
The material contained in Exhibits "A" and "B"_to this ordinance shall not be included in thejormal
mulllcipal codifìcation of ordinances, but shall be maintained as a public record in the offìce of the City
BuJidl11g omclal and will be available for public inspection and copying during regular business hours.
SECTION 4
ThIs ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas, except
where the provisions of this ordinance are in direct conflict with the provisions of such ordinances. in
whIch event the conflicting provisIons of such ordinances are hereby repealed.
SECTION 5
It IS hereby declared to be the intention of the City Council that the phrases, clauses, sentences,
paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or
section of this ordlllance shall be declared unconstitutional by the valid judgment or decree of any court
of competent junsdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences,paragraphs and sections of this ordinance, since the same would have been enacted by the City
council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence,
paragraph or section. It is not the intention of this ordinance to conflict in any way with the Plumbing
License Law of Texas.
SECTION 6
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who
resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two
Thousand Dollars ($2,000.00) for all violations involving zoning, fire safety or public_health and
sanitation, including dumping or refuse, and shall be fined not more than five hundred dollars ($500) for
all other violations of this ordinance. Each day that a violation is permitted to exist shall constitute a
separate offense.
SECTION 7
All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the
provisions of any ordinances affecting the installation and maintenance of systems which have accrued at
the time of the effective date of this ordinance; and, as to such accrued violations and all pending
litigation,both civil and criminal, whether pending in court or not, under such ordinances, same shall not
be affected by this ordinance buy may be prosecuted until final disposition by the courts.
SECTION 8
The City Secretary of the City of Southlake is hereby authorized to publish this ordinance in book or
pamphlet form for general distribution among the public, and the operative provisions of this ordinance as
so published shall be admissible in evidence in all courts without further proof than the production
thereof.
SECTION 9
The City Secretary of the City of Southlake is hereby directed to publish in the official newspaper of the
City of Southlake, the caption, penalty clause, publication clause and effective date_of this ordinance one
time within ten days after passage of this ordinance, as required by Section 3.13 of the Charter of the City
of Southlake.
SECTION 10
This ordinance shall be in full force and effect from and after its passage and publication as required by
law,but not sooner than September 30,2004 and it is so ordained.

SECTION 109
MEANS OF APPEAL
109.1 General. In order to hear and decide appeals of orders, decisions or determinations made by the buildinq official
relative to the application and interpretation of this code, there shall be and is hereby created a board of appeals. The

Buildinq Board of Appeals as established by ordinance 622 as amended shall constitute the Board of Appeals
referenced in this code,
109.2 Limitations on authority. An application for appeal shall be based on a claim that the true intent of this code or
the rules leqally adopted thereunder have been incorrectly interpreted, the provisions of this code do not fully apply, or

312.9.1 Inspections. Annual inspections shall be made of all backflow prevention assemblies and air gaps to
determine whether they are operable. (See Ordinance No. 699, Cross Connection Control Policy.)
312.9.2 Testing. Reduced pressure principle backflow preventer assemblies, double check-valve assemblies,
pressure vacuum breaker assemblies, reduced pressure detector fire protection backflow prevention assemblies,
double check detector fire protection backflow prevention assemblies, hose connection backflow preventers, and spill-
proof vacuum breakers shall be tested at the time of installation, immediately after repairs or relocation and at least
annually, The testing procedure shall be performed in accordance with applicable local provisions. In the absence of

2. Groups A. B, F, H, I, M and S Occupancies: Buildinqs or portions thereof where persons are employed shall
be provided with at least one water closet for each sex except as provided for in Section 403,2.
3, Group E Occupancies: Shall be provided with fixtures as shown in Table 403.1.
4, Group R Occupancies: Shall be provided with fixtures as shown in Table 403.1,
It is recommended, but not required, that the minimum number of fixtures provided also comply with the number shown
in Table 403.1 Types of occupancies not shown in Table 403.1 shall be considered individually by the code official,
The number of occupants shall be determined by the International Building Code, Occupancy classification shall be
determined in accordance with the International Building Code,

When discharqinq outside the buildinq, the point of discharqe shall be with the end of the pipe not more than
two (2) feet (610 mm) nor less than six (6) inches (152 mm) above the qround or the floor level of the area receivinq
the discharqe and pointinq downward, (Reason: To provide a higher degree of safety.)
