0869 2003 Intemational Energy Conservation Code ORDINANCE NO. 869 OFFICIAL RECORL AN ORDI"IANCE ADOPTING THE 2003 EDITION OF THE INTERNATIONAL ENERGY CONSERVATION CODE, REGULA TlNG THE DESIG"I OF BUILDING ENVELOPES FOR ADEQUA TE THERMAL RESISTANCE AND LOW AIR LEAKAGE AND THE DESIGN AND SELECTION OF MECHANICAL, ELECTRICAL, SERVICE WATER-HEATI"IG AND ILLUMINATION SYSTEMS AND EQUIPMENT IN THE CITY OF SOUTHLAKE AND; PROVIDING FOR THE ADOPTION OF LOCAL AMENDMENTS THERETO; PROVIDING FOR_RECORDING OF SITCH CODE AS A PUBUC RECORD; PROVIDING THAT THIS ORDI]\ANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAI1SE; PROVIDI"IG FOR PCBLICATION IN PAMPHLET FORM; PROVIDING FOR PUBUCATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake is a home rule city acting under its charter adopted by the electorate pursuant 10 ArtJClc XL Section" of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the 77th Texas Legislature adopted Senate Bill 5 requiring cities to adopt the 2000 International Energy Conservation Code, and the City Counci] of the City of Southlake deems it necessary to adopt this ordinance providll1g minimum standards to regulate the design of building envelopes for adequate thermal resistance and low air leakage and the design and selection of mechanical, electrical, service water-heating and illumination systems and equipment which will enable effective use of energy in new building construction. WHEREAS, beginning in the summer of2003, NCTCOG's Regional Codes Coordinating Committee (RCCC) and its four advisory boards conducted 26 open review meetings over a 10- month period to review the 2003 editions of the International Codes and to develop regional amendments. Their review and recommendations were completed and endorsed by NCTCOG's Executive Board in March 2004. Now NCTCOG encourages jurisdictions in North Central Texas to adopt the 2003 International Energy Conservation Code along with its respective regional amendments with an effective date of July 1,2004: "lOW. THEREFORE, BE IT ORDAINED BY THE CITY COI;NCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1 That the International Energy Conservation Code, 2003 Edition, published by the International Code Council. including the standards referenced therein, is hereby adopted as the Energy Conservation Code of the City of Southlake regulating the design of building envelopes for adequate thermal resistance and low air leakage and the design and selection of mechanical, electrical, service water-heating and illumination systems and equipment in the City of Southlake, except for fuel faciJities otherwise regulated under the International Residential Code for One- and T\\()- Family Dwellings as adopted. A true and correct copy of this document is attached as Exhibit "A." SECTION 2 That the 2003 International Energy Conservation Code, as adopted herein, is hereby amended as_provided in Exhibit "B" incorporated herein and attached hereto for all purposes of this ordinance. The City of Southlake, Texas may from time to time determine that additional local modifications to the Energy Conservation Code are necessary and appropnate to meet the unique needs of the City of Southlake, Texas. To effectuate these local modifications, the. Cltv ('¡)Unci! shall enact individual ordinances amending this Ordinance, fully setting forth the change to be made III the'Energy ConservatIon Code. Cpon adoption, copies of these amendments shall be attached to Exhibit "B" to this Ordinance. SECTION 3 The material contained in Exhibits "A" and "B"Jo this ordinance shall not be included in theJormal municipal codificatIon of ordinances, but shall be maintained as a public record in the office of the City Building Official and will be available for public inspection and copying during regular business hours. SECTION 4 ThIs ordinance shall be cumulative of all provisions of ordinances of the City of Southlake, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflictmg provisions of such ordinances are hereby repealed. SECTION 5 It IS hereby declared to be the intention of the City council that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause sentence, paragraph or section of this ordinance shall be declared unconstitutional by the vaJid judgment or decree of any court of competent jurisdiction, such unconstitutionaJity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstihltional phrase, clause, sentence, paragraph or section. SECTION 6 Any person, firm or corporation who violates, disobeys, omits. neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($ 2,000.00) for all violations involving zoning, fire safety or public health and sanitation, including dumping or refuse, and shall be fined not moreJhan five hundred dollars ($500) for all other violations of this ordinance each day that a violation is permitted to exisl shall constitute a separate offense. SECTION 7 All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of any ordinances affecting the regulation of the design of building envelopes for adequate thermal resistance and low air leakage and the design and selection o(mechanical, electrical service water-heating and illumination systems and equipment within the City which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 8 The CIty Secretary of the City of Southlake is hereby authorized to publish this ordinance in book or pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shaH be admissIble m evidence in aU courts without further proof than the production thereof. Underlined type is text inserted. Lined through typo is deleted text from the IECC. A double asterisk at the beginning of a section identifies an amendment carried over from the 2000 edition of the code and a triple asterisk identifies a new amendment with the 2003 edition of the code. After each code amendment a reason is given in parentheses. The reason is not a part of the code, but is given to aid in understanding the code. **Add the following section: 101.4.1.3 Alternative compliance.
