AN ORDINANCE AMENDING ORDINANCE NO.
161 OF THE CITY OF SOUTHLAKE BY
AMENDING THE ZONING CLASSIFICATION
OF 1.2 ACRES OUT OF THE SAMUEL
FREEMAN SURVEY, ABSTRACT NO. 525
OWNED BY JAMES H. WINFREY FROM
"AG AGRICULTURAL DISTRICT" TO
"H HEAVY COMMERCIAL DISTRICT"
WHEREAS, after receipt of request for change of zoning,
notice given to applicable property owners of public hearing,
notice of public hearing published, and public hearing having
been conducted, all in compliance with Ordinance 161 of the
City of Southlake, Texas,
NOW, THEREFORE:
Be it Ordained by the City Council of the City of
Southlake, Texas:
SECTION 1. The certain Ordinance No. 161 passed by the City
Council of the City of Southlake, Texas, January 7, 1969, and
being the "Comprehensive Zoning Ordinance" is hereby amended
insofar as the 1.2 acres of land, more or less, owned by James
H. Winfrey, out of the Samuel Freeman Survey, Abstract No. 525,
Tarrant County, Texas, and more particularly described by metes
and bounds as follows:
Being part of a 1.75 acre tract conveyed to W.
Allumbaugh et ux by J. M. Mitchell et ux 12/2/5d
as recorded in Vol. 3266, Page 3d5, DRTCT, and
Beginning at an iron pin 302.2 ft. East and 129.3
ft. North of the Southeast corner of the T. Mahan
Survey A-1049; Thence NO-54W 20.4 ft. to an Iron
Pin, being in the South Right of Way of S.H. 1709;
Thence along said S.H. the following courses:
N51-50E 100.0 ft. N40-25E 33.63 ft.; Thence S7-26E
175.46 ft. to a point; Thence S89-06W 195.0 ft. to
Point of Beginning and containing .408 acres, more
or less; And an additional part of the same 1.75
acre tract conveyed to W. Allumbaugh et ux by J.
M. Mitchell et ux 12/2/5d as described in Vol.
3266, Page 2d5, DRTCT, and Beginning at the most
northerly corner of a tract of land conveyed to
J. Winfrey et ux by W. Allumbaugh as described
in Vol. 3474, Page 593, DRTCT, said point
being in the Southeasterly Right of Way of
S.H. 1709; Thence along said 1709 Highway
the following courses: N40-25E 66.37 ft.,
N34-58E 100.0 ft., N29-16E 100.0 ft.,
N23-25E 68 ft., N20-30E 53.20 ft. to a
point in a county road; Thence SO-25W,
down county road 358.0 ft to a point;
Thence S89-06W 17.75 ft. to a stake in
the West Right of Way of road, in all,
189.57 ft. to a point; Thence N7-26W 29.80
ft. to Point of Beginning, containing a gross
acreage of .750, more or less,
is changed from its prior zoning classification of " 'AG'
Agricultural District" to a zoning classification of " 'H'
Heavy Commercial District".
SECTION 2. The official zoning map created by said Ordinance
No. 161 is hereby amended to reflect the change in zoning
classification made by this Ordinance.
SECTION 3. The said Ordinance No. 161, except as amended
by this Ordinance No. 1 61 -2, and Ordinance No. 161-1, re-
mains in effect in all other respects as originally passed.
This Ordinance shall take effect after its passage
and any publication or posting, if any, as required by law.
