16-037 RESOLUTION NO. 16-037 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT SPECIFIC USE PERMIT FOR A RESIDENTIAL ABOVE GROUND CISTERN WITHIN THE CITY OF SOUTHLAKE, TEXAS, LOCATED AT 1407 NORTHRIDGE DRIVE, BEING DESCRIBED AS LOT 7, BLOCK 3 HARBOR OAKS SUBDIVISION AS DEPICTED ON THE APPROVED SITE EXHIBIT ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit Specific Use Permit for a Residential Above Ground Cistern has been requested by a person or corporation having a proprietary interest in the property zoned as "SF-1A" Single Family Residential District; and, WHEREAS, in accordance with the requirements of Section 45.1 (45), 45.47 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a Residential Above Ground Cistern on residential property on 1065 Harbor Haven being described as Lot 7, Block 3 Harbor Oaks Subdivision as depicted on the approved Site Exhibit attached hereto and incorporated herein as Exhibit "A" and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein. Resolution No. 16-037 Page 1 City Council motion for approval: September 6, 2016; Approved (7-0) subject to the Staff Report dated August 30, 2016; granting the variance a 26-foot rear yard setback for the required 40-foot setback from the rear property line in the underlying zoning district of "SF-1A" Single Family Residential District. This would allow a larger vegetable garden; and granting the variance to the materials requirement to allow a dark green poly cistern for the requirement that the materials must be compatible with architecture and/or color of the principal building or structure (the existing building is a light sand stucco and tan brick); and also noting that all landscaping shown on the site plan and discussed this evening will be planted prior to the installation of the cistern; and the plant materials shall be maintained by the cistern being utilized by the property owner. SECTION 2. This resolution shall become effective on the date of approval by the City Council. PASSED AND APPROVED THIS 6th DAY OF September, 2016.
