Requested Zoning: R -PUD Residential Planned Unit Development District. SPIN Neighborhood # 5. PUBLIC HEARING Paul Spain, 2200 Estes Park Drive, Southlake came forward. Mr. Spain gave a presentation showing the subdivision and the surrounding areas and zoning. Mr. Spain continued to show the drainage moving northwest and tree buffer along Highland Street to keep the feel of the area. The trees along the perimeter will be saved along with the existing vegetation. Several more will be planted within the subdivision along the streets. Commissioner Fairchild stated that 15 lots are being presented but under the 2030 Plan Planning and Zoning Commission Meeting Minutes —July 19, 2012 Page 4 of 12 this area would have allowed under low density up to 9 lots. Mr. Spain believes that this area is not good for a large lot and large house development. This is the perfect buffer area between low density to the south of Highland and medium density to the north of Highland. The lots that face Highland are 'A acre and the ones to the west are 1/2 acre. It is only midway back that the lots are smaller. Commissioner Springer asked about the fencing on the west side. Mr. Spain explained that there will be an iron fence to show the existing vegetation. Chairman Hudson asked about the drainage and if Mr. Spain intended to go underground to the retention pond. Mr. Spain stated yes. There will be curb and gutter into the streets and the runoff from the site will drain into the detention pond. The drainage from south of Highland would go directly through the project and out the north end. Commissioner Fairchild asked what the reasoning is behind not gating the subdivision. Mr. Spain explained that the City does not consider it to be desirable. Commissioner Springer asked about the power lines along Highland. Mr. Spain explained that they are secondary lines which make them prohibited to bury. Commissioner Williamson asked about Lot 9. He expressed concerned about backing up to commercial zoning. Mr. Spain stated that commercial office space can be a good neighbor. They provide a good buffer from traffic and no weekend hours. Chairman Hudson opened and closed the public hearing. Commissioner Parrish expressed concerned about Lot 9 backing up to a future parking lot. Commissioner Williamson agreed with Commissioner Parrish but overall likes the project. Mr. Lyssy stated that the colors will be more earth tone than the colors presented in the pictures. Commissioner Fairchild asked about the turning lane along Davis Boulevard and if there will be a sign stating no left turn. Mr. Lyssy stated no, but one can be added if necessary. Commissioner Parrish asked about the time frame. Mr. Lyssy stated about 6 months. Commissioner Springer asked if there would be a drive thru. Mr. Lyssy stated yes. Chairman Hudson asked about the hours of operation. Mr. Lyssy stated 6am to lOpm. Commissioner Williamson asked about patio seating. Allen Survey, Abstract No. 18 and Lot 4R3, Block 1, Watermere at Southlake, an addition to the City of Southlake, Tarrant County, Texas located at 2261, 2271 & 2451 Union Church Road and 451 Watermere Drive, Southlake, Texas. Current Zoning: R- PUD Residential Planned Unit Development District and S -P -2 Generalized Site Plan District. Requested Zoning: TZD — Transition Zoning District. SPIN Neighborhood # 11. PUBLIC HEARING Scott Simmons, 3110 W Southlake Blvd. came forward. The most considerable change will be on the west side and will be the removal of the gates and the age restriction will be lifted. The west side will not have access to the amenity centers. On the east side the age restriction will remain. The size of the homes on the west side will be limited to 3,700 sq. ft. a /c. with a side yard setback of zero lot line. Mr. Simmons continued to state that they have worked to reach all the neighbors and address all concerns. Scott Simmons continued regarding the changes to the amenity center. The request is to remove the outdoor pool, the fishing pier, outdoor kitchen and one tennis court. Add a trellis to the horseshoe pit, area for shuffle board, a pavilion and reduce parking spaces by 8 and add a putting green. These are request from the advisory board at Watermere. Commissioner Springer and Commissioner Parrish asked about the amenity center and the club house. Mr. S. Simmons stated that the club house with the restaurant, fitness center and indoor pool is for east side Watermere residents only. The amenity center is open to all residents including the west side. Commissioner Williamson asked about the survey and how the results were calculated. Mr. S. Simmons explained that the 47 out of 49 residents sign the petition approving the changes. Rick Simmons came forward and stated that they have been working closely with the Planning and Zoning Commission Meeting Minutes —July 19, 2012 Page 7 of 12 neighborhood of Watermere and the residents to address their concerns as well communicate the changes they would like make. Commissioner Williamson asked how many residents currently live in the age restricted area. Mr. S. Simmons answered about 53 — 55 residents. Commissioner Fairchild stated that previously, this was presented with the residents to the west becoming members of the club house. Was this a concern of the residents to the east? Mr. S. Simmons answered yes. Commissioner Fairchild asked Mr. Simmons if he considered this a high density development on its own separate from Watermere. Mr. S. Simmons answered no. Larry Delzow, Darling Homes, 2500 Legacy Dr., Ste. 100, Frisco. The style of these homes target the empty nesters or clients with no children. Commissioner Williamson verified that Mr. Delzow will be purchasing the lots. What will the advertisement be to purchase these lots? Mr. Delzow stated his target audience will be residents in surrounding communities who are empty nesters with an active life style that is looking for a smaller house and low maintenance on their lot. Commissioner Parrish asked about the price range. Mr. Delzow stated starting price is $400,000.00. Chairman Hudson read aloud the cards and opened the public hearing. Public Comment Cards; Sam Feazell, 324 Watermere Dr.; Larry Crosser, 302 Watermere Dr.; Jay Parr, 301 Watermere Dr., #107 — all in support of this item, but do not wish to speak. Db Real Estate Assets II Llc, 130 Royall St. Canton, MA is undecided. John Twining, 312 Watermere Dr. came forward. Mr. Twining is in support based on his conversations and meetings with Mr. Simmons. Jody Hanson, 608 Melrose Ct. came forward. Mrs. Hanson is in support of the project. Mrs. Hanson expressed that she is the type of client they are looking for and is an empty nester along with several of her friends and is looking forward to purchasing a home. Commissioner Fairchild asked Mrs. Hanson what her ideal square footage would be. Planning and Zoning Commission Meeting Minutes —July 19, 2012 Page 8of12 Mrs. Hanson stated about 3,200 square foot. Mr. and Mrs. Mortazavi, 2499 Union Church Rd. came forward. Mrs. Mortazavi expressed concerned about drainage and have had meetings with Mr. Simmons regarding drainage. Would like to see the development work but the drainage needs to be worked on. Due to the problem, property has flooded on several occasions destroying property and structures. Mr. Mortazavi showed several pictures of the flooded area over the years. Mr. Mortazavi would like Watermere to direct the water away from their property. Jay Behrens, 3100 Merrimac Ct. came forward. Mr. Behrens lives to the west of the property line of the project being proposed and is in support of the project and the builder. Commissioner Springer asked Mr. Behrens if there was a drainage issue on your side in the past. Mr. Behrens stated yes, but Watermere since then has put in a ditch and helped run the water in a different direction. Chairman Hudson closed the public hearing. S. Simmons came forward and stated from the beginning they have taken on 800 acres of drainage. The improvements started with the lake that was built which took on the majority of the drainage. All drainage has been implemented based on City approval and inspection. Commissioner Parrish asked if Mr. Simmons had any concerns about the lot size and the zero lot line. It seems there are a lot of these Tots being developed and the concern is, will there be too many. R. Simmons and Larry Delzow came forward and stated all homes will be 2,800 sq. ft. to 3,200 sq. ft. which will take up the lot with low maintenance. There is a large market for these types of lots but not just with empty nesters, but with young couples that have no children. Commissioner Springer would like to verify the original elevations. Steve Anderson came forward and showed the Commission the original drainage and the current drainage. The exhibits show that there was a 4 -ft build up along the Mortazavi property which aids the drainage back onto the Watermere side into the street which has decreased the drainage along their property. Commissioner Fairchild asked about the current slope that is present and if the property is draining correctly. Commissioner Williamson verified that the drainage should be better as Watermere continues to develop. Simmons would like to raise the grade and take on the drainage 100% with a retaining wall but believes that Mr. Morazavi doesn't believe it will help. Commissioner Williamson asked if it was possible to direct the water from the Morazavi property. S. Simmons stated that he could not answer this at this time without the proper research and more information. Chairman Hudson pointed out that the drainage cannot be fixed tonight. However, it does need to be addressed at a later date. Chairman Hudson also pointed out that Mr. Morazavi is not asking you to drain their property only to stop the drainage from coming from Watermere. Chairman Hudson continued to address the density of the lots. Commissioner Fairchild is concerned about the lot size being too big which would allow larger homes. Larry Darling Homes stated that the average house is 3,200 sq. ft. maximum. Commissioner Fairchild understands the premise, but what is to keep another builder from coming forward. Chairman Hudson asked Mr. Simmons to address the density issue before City Council but is in favor of the development. Commissioner Williamson is comfortable with the density and likes the project. Commissioner Fairchild addressed Mr. and Mrs. Morazavi regarding their issue and believes that once the development is completed the drainage will resolve itself. Also, Commissioner Fairchild likes the development but is uncomfortable about the lot size. Commissioner Parrish is comfortable with the development. Commissioner Springer asked if there will be another spot where the water will cross the road rather than the existing point it goes out now. Mr. Anderson stated that it will go under Union Church Road. Commissioner Parrish verified that these plans will start in about 2 -3 years. Mr. Anderson answered yes. Chairman Hudson asked about the Tier 2 projects and what the time frame was. Mr. Anderson stated 3 -6 years. Chairman Hudson opened and closed the public hearing.
